SUBJECT: Execution of DTPA Waiver Request and Performance Agreement
SPECIFIC AEOUEST(S)OR RECOMMENDATION{S}&BACKGROUND AND JUSTIFICATION
Ia RECOMMENDED ACTION:
Authorize Chair, Contra Costa Board of Supervisors to execute as the CEO for the
Contra Costa DTPA Service Delivery Area a DTPA Waiver Request and Performance
Agreement for program year 1998-1.999.
IL FINANCIAL IMPACT:
None; waiver requires no additional expenditure of DTPA grant funds and requires no
County general fund expenditure.
III. CHILDREN IMPACTSTATEMENT:
The waivers are expected to increase the departmental ability to provide timely and
effective DTPA program services; this will support the third outcome — Families that are
economically self-sufficient.
IV. REASONS FOR RECOMMENDATION:
On July 21, 1997, State JTPD notified PIC/SDAs that a DTPA wavier package had been
submitted to DOL and advising PIC/SDAs to decide which waivers, if any, they would
apply for after seeking public review. We notified contractors and interested parties of
the available waivers and solicited input. Although input was limited, it was all positive.
Shortly thereafter, the State notified us that DOL had not accepted the State submittal
and negotiations were underway.

On June 4, 1998 State STPD notified PIC/SDAs that they had come to agreement on a
-modified waiver participation_ and authorized the PIC One Stop Committee to select
from the available menu which waivers were to be implemented.. On July 13, 1998, after
public review and input, the PIC One Stop Committee decided to implement all available
waivers. There was no opposition expressed to any of the waivers.
The DTPA waivers - which are not judged by staff to be earth shaping - will allow the
PIC/SDA to provide a somewhat enhanced level of employment and training services
mmore closely tailored to individual participants. There is an expectation that program.
outcome performance will increase by S%as a result of implementation of the waivers.

C. Describe your local public process for adoption of the waivers:
On 18 August 1997 JPTA Directive 97-1 was distributed with a transmittal PICC
Administrative Bulletin advising of the }possibility of DTPA waivers and requesting
public input. The limited response wa$ all positive. No further action was taken
after we were notified that D.CL had not approved the request and was in negotiation
with the State. On 34 .lune 1398, another public meeting was made, with a public
review of the proposed action conducted by the PIC One Stop Committee on 13 July 1998.
All input was again positive. The committee action was authorized at the 25 dune
1998 PIC Meeting.
D, Describe the actions you will take to remove soca' barriers (Le.,.policies, guidelines, rules and regulations):
Contra. Costa PIC/SLA will review and as necessary revise contract language and
operating instructions that are in conflict rth the waivers. Full implementation
of Post Program Services and implementation of Employment Generating Services will
be delayed until JTPD issues clarifying instructions and State policy directives
and instructions on implementation.
E. Date(s) of implementation for optional waivers:
Will be effective for PY 98/99 only unless waiver authority is extended. If State
waiver authority is rescinded, Contra Costa PIC/SDA will discontinue the application
of waivers.
