The Floud Control and Water Conservation District recommends that all bids be rejected.
Pursuant to Public Contract Code Section 20393, as well as the Notice to Contractors, the Board
in its discretion may reject all bids.
IV. Consequences of Negative Action:
If the bids are not rejected, the bids remain valid for another 17 days. This could affect the
bidders' ability to bid other work.

harmless the Jahn Swett Unified School District(JSUSD) from claims arising from the County's negligent
acts resulting from the County's use of the School District's facilities in County Service Area P-1 (Crockett).
II Financial Imnact:
There is no impact to the general fund. County Service Area P-1 is covered under the County's self-
insurance program.

111. Reasons for Recommendation and Background:
The Citizens Advisory Committee for County Service Area P-1 (Crockett)would like to provide a variety
of classes for the community such as cooking,computers,etc. The John Swett School District has agreed
to allow the Service Area to use it's facilities (such as the home economics class room for community
cooking classes) free of charge. The School District has requested that the County indemnify and hold the
School District harmless from any claims arising from the Service Area's use. The County's Risk Manager
has reviewed the School District's request and has recommended that the County indemnify and hold the
School District harmless from any claims resulting from the Service Area`s use.
IV. Consequences of Negative Action:
If the County does not agree to indemnify and hold the school district harmless, County Service Area P-1
(Crockett)will not be able to use the School District's facilities for public classes.

Re: Use of John Swett Unified School District Facilities by
Crockett Community Center
The County of Contra Costa has a comprehensive self-insurance program to cover its
general and automobile liability exposure, as well as its obligations under the Workers'
Compensation laws of California.
The County's self-insurance program provides for the legal defense of officials,
employees, and volunteers pursuant to Covemment Code Section 825 and for the
payment of all sums that the County is obligated to pay by treason of liability imposed
by law and arising from acts or failures to acct, excepting punitive damages. This
protection covers services performed by officers, employees, and volunteers within the
scope of their official duties in accordance with the conditions of their employment or
service.
The self-insurance program is funded to provide payment of claims.
Indemnification. The County shall defend, indemnify, save and hold harmless the John
Swett Unified School District, its officers and employees from any and all claims, costs
and liability for any damages, sickness, death, or injury to person(s) of property arising
directly or indirectly from or connected with the operations or services of the County or
its officers and employees, save and except claims or litigation arising through the sole
negligence or sole willful misconduct of the John Swett Unified School district, its
officers or employees.

County will make good to and reimburse the John Swett Unified School District for any
expenditures, including reasonable attorneys'fees the John Swett Unified School District
may make by reason of such matters and, if requested by the John Swett Unified
School District, will defend any such suits at the sole cast and expense of the County.

I. Recommended Action:
APPROVE and AUTHORIZE the Public Works Director to execute contracts with Berryman and Hen gar
in an amount not to exceed$35,000.00 for preparation of the annual engineer's report, diagrams and tax roll
for the Countywide Landscape District(AD 1979-3, LL-2) for Fiscal Year 1998-99.
II Financial Impact:
The contracts will be paid out of landscape assessments collected by the Countywide Landscape District
pursuant to the Lighting and Landscape Act of 1972.
III. Reasons for Recommendation and Background:
Each year the County is required to renew it's landscaping program assessments. The County has over the
past several years used the services of a onsultant special zing in assessment district work.

This year, in addition to the normal engineer's report, mail-in ballots were sent out to three small zones
containing tot lots and parks. Proposition 218 requires voter approval for those existing zones where
assessments are used to fund park facilities. The Board approved the mail out of these ballots on June 2,
1998. On July 28, 1998, the Board accepted the canvass of ballots which confirmed the continuation of
existing assessments in the three zones affected by Proposition 218 and approved the continuation of
assessments in all other existing zones.
IV. Consequences of Negative Action:
The Consultant will not be able to be reimbursed for their expenses.

The project cost is funded by Federal Emergency Management funds(75%)and State(25%) funds, except
Wildcat Creek Channel which is funded by Flood Control District Zone 7 (100%) funds.
III. Reasons for Recommendations and Background.
The project includes repairing bank erosion and slip-outs by excavating and removing loose slope material
and replacing it with rock slope protection(RSP). One location requires silt removal from stream channels.
Some small diameter non-native trees may be removed to complete the project, however, they do not
represent a scenic resource. Repairs will occur at the following sites.

11. Financial Impact:
This amendment will increase the amount of the Joint Exercise of Powers Agreement by
approximately $8,000. There will be no impact to General Fund. This Joint Exercise of
Powers Agreement is funded with stormwater utility fees collected by the Contra Costa
County Flood Control & Water Conservation District on behalf of the Contra Costa Clean
Water Program.
Ill. Reasons for Recommendations and Background:
The San Francisco Bay Regional Water Quality Control Board requires the Contra Costa
Clean Water Program, which is composed of twenty (20) public agencies including Contra
Costa County, 18 of its incorporated cities and the Contra Costa County Flood Control &
Water Conservation District, to conduct special studies to determine the effectiveness of best
management practices (BMPs) in removing pollutants from stormwater runoff. Runoff from
commercial parking lots has proven to be a source of pollutants. As part of the Joint National
Pollutant Discharge Elimination System (NPDES) Municipal Permit, public agencies are
constantly seeking effective BMPs to remove pollutants from .stormwater in a cost-efficient
manner.
The City of San Ramon contracted with Woodward-Clyde Consultants, Inc. (now Woodward-
Clyde International Americas)to conduct a study on two stormwater interceptors installed to
collect runoff from two large commercial parking lots in San Ramon. The study modification
includes cleaning of the interceptors and sampling and analysis of samples
The Contra Costa Clean Water Program has funded this study through an agreement
between the City of San Ramon and the Contra Costa CountyFlood Control & Water
Conservation District. The Board of Supervisors, as the governing body of the Contra Costa
County Flood Control and Water Conservation District approved the initial study project on
June 25, 1996.
IV. Conseggences of Negative Action:
The San Francisco Regional Water Quality Control Board may find the Contra Costa Clean
Water Program is not conducting special studies as required in its Joint Municipal NPDES
Permit. The Regional Board has the authority to fine the municipalities in the Contra Costa
Clean Water Program up to $10,0100 per day and $10 per gallon of discharge for non-
compliance with the permit.

1. P r ie . Effective Aigwt 11, 1998 , the CONTRA COSTA COUNTY FLOOD
CONTROL AND WATER CONSERVATION DISTRICT, a body corporate and politic,
hereinafter referred to as "DISTRICT,"and the CITY OF SAN RAMON, a municipal
corporation,hereinafter referred to as"CITY,"pursuant to Government Code Section 6500 and
following, mutually agree and promise as follows:
2. Purpose. The parties desire to amend that Joint Exercise of Powers Agreement, dated July
23, 1996,apportioning project duties and costs between CITY and DISTRICT in connection
with the Special Project To Remove Pollutants From Commercial Parking Lot Stormwater
Runoff.
3. Amendments.
(a) Exhibit A to the Agreement is amended by adding the"Addendum No. 1 To Exhibit
A," attached hereto and incorporated herein by this reference.
(b) Section 9 of the Agreement is amended to read as follows;
This AGREEMENT shall expire upon delivery of the report of
receipts and disbursements and payment of all funds specified
herein, or on August 31, 1998,whichever occurs last, except for
the provisions of Section 6, which shall survive expiration of this
AGREEMENT.
4. Effect, Except as amended herein, the Joint Exercise of Powers Agreement of July 23, 1996,
remains in full force and effect.

ADDENDUM NO. I TO EXHIBIT "A"
Addendum Scope of Work and Cost Estimate
Initial sampling of the two Jensen Interceptors indicated that inordinate amounts of sediments
had accumulated in various cells of the two interceptors. This sediment was not considered
representative of the "built out"condition of the interceptor. Therefore the following tasks
were required to evaluate the performance of the intercepters in an appropriate manner:
Task 1:
Clean the existing interceptors to remove accumulated sediment. Dispose of the accumulated
material and wastewater generated during the cleaning operation. This task included
determining the nature of and estimating the amount of material in the cells, evaluating
options for disposal of the water and sediment, communication with different contractors,
overseeing the cleaning operation, and sub-contracting a qualified cleaner.'
Task 2:
Resample the sediment and water in the interceptor.
Estimated Cost:
The total cost of these tasks is not to exceed$8,000.00.

funded with stormwater utility fees collected by the Flood Control District on behalf of the
eleven (11) participating municipalities
111. Reasons for Recommendations and Background:
The San Francisco Bay and Central Valley Regional Water Quality Control Boards require
municipalities in the Contra Costa Clean Water Program to conduct stormwater inspections
at commercial and industrial facilities. These inspections are mandated by the Joint Municipal
National Pollutant Discharge Elimination System (NPDES) Stormwater Permit issued to the
municipalities. The inspections are intended to radically reduce or eliminate polluted runoff
from commercial and industrial facilities.
Eleven (11) municipalities have requested two (2) sanitary districts to conduct their
stormwater inspections. This unique arrangement between municipalities and sanitary
districts creates a comprehensive approach that will address polluted runoff from industries,
commercial/retail businesses and residents. Sanitary district pretreatment inspectors will
conduct inspections, which will eliminate the need to create a new bureaucracy. This
agreement authorizes the Flood Control District, on behalf of the municipalities, to receive
inspection services from the sanitary districts. All inspection activities will be funded from
stormwater utility assessment revenues collected for the municipalities.
