DATE: July 28, 1998 SUBJECT: AUTHORIZE THE DISTRICT V SUPERVISOR TO TAKE SPECIFIC ACTIONS WITH REGARD TO THE KELLER CANYON LANDFILL MITIGATION jFUNDING PROCESS SPECIFIC REQUEST(S)OR RECOMMENDATION(S)AND JUSTIFICATION RECOMMENDED ACTION: Authorize the District V Supervisor to take specific action, as follows, with regard to the Keller Canyon Landfill Mitigation funding process for the current fiscal year. 1) Authorize the District V Supervisor to appoint an Interim Review Committee, comprised of County staff, to review funding allocations and make recommendations on Keller Mitigation funds for Fiscal Year 1998/99. 2) Direct the County Administrator's Office to develop an estimate of funds available for allocation based on the current reduction of tonnage, taking into account the diversion of materials from the Keller Landfill for a period of up to six months and disposal of those materials at other landfill sites. 3) Direct the Interim Review Committee to review the fiscal estimate and provide funding recommendations for the first six months of the Fiscal Year 98/99. Further, direct the Interim Review Committee to review these allocations in January 1999 to determine funding for the balance of Fiscal Year 1998/1999. 4) Direct the District V Supervisor, in conjunction with Community Development staff, to commence recruiting for permanent members of the Community Advisory Panel during the first quarter of 1999.' This will allow the full panel to be appointed and in place prior to April 1999 when the funding process will commence for Fiscal Year 1999/2000. BACKGROUND INFORMATION: On April 28, 1998 the Finance Committee recommended, and the Board of Supervisors adopted, changes to the policies and procedures for the allocation of 1998/1999 Keller Canyon Mitigation funds. The diversion of these materials commenced in June 1998, and may continue to be diverted for a period of up to six months. The diversion of these materials will have a significant impact on the projected Keller Canyon Mitigation revenues available for Fiscal Year 1998/99. Given the fact that the current fiscal year has already commenced, and the uncertainty of funding levels for the current fiscal year based on the projected diversions, it is recommended that an interim process be implemented that will allow for the allocation of funds at the earliest opportunity and provide for a subsequent review at a six month interval. Recruitment of a Community Advisory Panel is estimated to take a minimum of two months (from advertising to appointment), and following appointment, a two month process (at a minimum)to bring funding allocations to the Board. Staff believes that this will create an unnecessary delay in the allocation of funding for the current fiscal year. For this reason, an Interim Review Committee has been proposed.
