THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on July 28, 1998, by the following vote: AYES: Supervisors Gerber, Canciamilla, and Rogers NOES: None ABSENT: Supervisors Uilkema and DeSaulnier RESOLUTION NO. 9$! 399 (Gov. Code§25528.5) SUBJECT: Conveyance of Excess Real Property to the Alamo-Lafayette Cemetery District CP#97-68 Project No. 0662-6U4333, Lafayette Area The Board of Supervisors of Contra Costa County RESOLVES THAT: Contra Costa County acquired certain real property in Lafayette, described in Exhibit"A" attached hereto. The property was the former alignment of Old Tunnel Road and was obtained through various relinquishments from the State of California. Said property is DETERMINED to be surplus and no longer necessary for County or other public purposes and its estimated value does not exceed $10,000.00. This Board hereby APPROVES and AUTHORIZES the conveyance of said property to the Alamo-Lafayette Cemetery District, pursuant to Government Code Section 25526.5, in exchange for the conveyance of District owned surplus property to the County. The Board Chair is hereby AUTHORIZED to execute a Quitclaim Deedon behalf of the County and the Board hereby ACCEPTS the Grant Deed from the District. The Real Property Division is DIRECTED to cause said Quitclaim Deed to be delivered to the grantee and the Grant Deed to be delivered to the Recorder. The Board hereby FINDS that the activity will not have a significant effect on the environment and DETERMINES that the activity is exempt from the requirements of the California Environmental Quality Act as per Section 15061 (b)(3) of the State CEQA Guidelines, and DIRECTS the Director of Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for filing of the Notice of Exemption. This activity has been found to conform to the General Plan of the City of Lafayette. July 28, 1998 Page 2 il. Financial Impact: There is no impact to the General Fund. The project is funded 100% by Transportation Enhancement Activities Fund and Regional Measure C funds provided by the Contra Costa Transportation Authority. Ill. Reasons for Recommendations and Background: The Contra Costa Transportation Authority, Contra Costa County, and the City of Pittsburg contemplate landscaping along State Route 4 from the Willow Pass Road Interchange to east of the Bailey Road Interchange, including surface streets within the unicorporated Bay Point area and the City of Pittsburg in the vicinity of Bailey Road. The Contra Costa Transportation Authority has committed $1,700,000 in current year dollars programmed for construction. The Contra Costa Transportation Authority requested the County Public Works Department administer the construction contract. The Memorandum of Understanding specifies the terms and conditions, under which the Landscaping Project is to be managed, engineered, advertised, awarded, administered, constructed, and financed. A provision in the Memorandum of Understanding states that the City of Pittsburg and the State of California will not accept control of and therefore are not responsible for maintaining their respective portions of the project until the three-year plant establishment period is over. County Counsel reviewed the agreement and is concerned that this provision could potentially undercut the protection to the County and could result in the County continuing to be liable for the City and State portions of the project until the end of the three--year plant establishment period. To reduce the liability exposure, the construction contract for the landscaping work will require the contractor to provide indemnification and insurance (including blanket contractual or contractual liability coverage)for the County, the City, the Authority, the State, and their officers, agents, and employees. The Transportation Committee has reviewed this issue. IV. Consequences of Negative Action: If the agreement is not approved, the implementation of the project would be delayed.
