RECOMMENDATIONS
A. ADOPT Urgency Ordinance to become effective immediately that will extend
the term of the East County Regional Planning Commission and the San
Ramon Valley Regional Planning Commission after October 6, 1997.

B. INTRODUCE the Ordinance, WAIVE reading and FIX October 7, 1997 for
adoption to extend the term of the East County Regional Planning
Commission and the San Ramon Valley Regional Planning Commission to
October 7, 1999. Ordinance NO. 97-37
FISCAL IMPACT
The cost in the Fiscal Year will be approximately the same as last year.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On December 20, 1994, the Contra Costa County Board of Supervisors extended
the term of the two Regional Planning Commissions to October 2, 1995 and on
September 26, 1995 extended their term to October 7, 1997. During that
period, staff was directed to monitor the activities of the Commissions and to
report back to the Board on the relative workload of each Commission.

Background/Reasons for Recommendations - Continued
During the past several years, the activities of the County Planning Commission and
the two Regional Planning Commissions have diminished due primarily to the slow
economic growth in the land development field. The economy has recently been
improving, however, and it appears there will be some increase in development
activities for the Commission's over the next two years.
The County is currently processing two very large development applications: the
Cowell Ranch project in East County and the Tassajara Valley Property Owners
Association project in South County. It would be very valuable to the public hearing
process for both of these large projects to have input from the Regional Planning
Commissions.
If the urgency ordinance is not adopted, scheduled hearings cannot be held and
discussions on pending applications cannot be made and some may be deemed
approved, which would frustrate Planning Agency land use regulations and public
hearing procedures.

ORDINANCE NO. 97-
(Extending Regional Planning Commissions)
The Contra Costa County Board of Supervisors ordains as follows (omitting the
parenthetical footnotes from the official text from the enacted or amended provisions of
the County Ordinance Code).
SECTION (. Commencing on October 7, 1997 and thereafter, sections 26-2.1510, 26-
2.1512 and 26-2.1514 are added to the County Ordinance Code to extend regional
planning commissions to read as follows:
26-2.1510 San Ramon Valley area. The San Ramon Valley Regional
Planning commission is established and shall have seven members and as its territorial
area of jurisdiction all of the unincorporated territory covered by the San Ramon Valley
General Plan adopted by the board on May 24, 1977, by Resolution No. 77/436, and
future amendments thereto.

26-2.1512 East County Regional Planning Commission. The East County
Regional Planning Commission is established and shall have seven members. The
commission's territorial area of jurisdiction is all of the unincorporated territory located in
the area bounded on the north, east and south by the Contra Costa County line and on
the west by a line beginning at the most northwesterly point of the Delta Diablo
Sanitation District and following the westerly border of that district and the extension of
that boundary line to the south to its intersection with the Concord city limit line,
following a northeasterly and then southeasterly direction along the easternmost
Concord city limit line, following a northeasterly and then southeasterly direction along
the easternmost Concord city limit and sphere of influence line to its intersection with
the Clayton sphere of influence line, following the line to its northeastern ment point, and
from that point to the southwest corner of the Black Diamond Regional Reserve,
following the southern border of that reserve to its most southeastern corner, and from
that point due south to its intersection with the easternment boundary of the San Ramon
Valley Area General Plan and following that boundary in a southeasterly direction to its
intersection with the Contra Costa and Alameda County line. The "East County
Regional Planning Commission Boundary Description Map," which is on file with the
clerk of this board, is adopted by this reference and available for public inspection in the
community development department.

26-2.1514 Repeal. Sections 26-2.1510 and 26-2.1512 of the County
ORDINANCE NO. 97-

Ordinance Code shall be repealed and of no further force and effect beginning on
October 7, 1999 unless this Board otherwise provides before then.

protect the public safety, health and welfare pursuant to the authorization of
Government Code section 25123 and Elections Code Section 3751, providing for the
extended and continued existence of the East County and San Ramon Valley Regional
Planning Commissions. The facts constituting the urgency are that if these urgency
provisions are not adopted, scheduled hearings can not be conducted and decisions on
pending applications before,the Commissions can not be made and some applications
may be deemed approved which would frustrate Planning Agency land use regulation
and public hearing procedures.
SECTION III. Effective and Operative Date. As an urgency ordinance, this
ordinance becomes effective and operative immediately on introduction and passage. If
a court holds it to be a non-urgency ordinance, it becomes effective 30 days after
passage (on second reading), and within 15 days of passage shall be published once
with the names of supervisors voting for and against it in the CONTRA COSTA TIMES a
newspaper published in this County.

(Extending Regional Planning Commissions)
The Contra Costa County Board of Supervisors ordains as follows (omitting the
