SUBJECT: Approval for Submission and Execution of Contract With the State Office
of Criminal Justice Planning for Funding of the Career Criminal
Unit for the Period of July 1, 1997 to June 30, 1998
SPECIFIC REQUEST(S)OR RECOMMENDATIONS&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
Authorize the District Attorney to submit an application and execute a grant award contract and any extensions or
amendments thereof, with the State Office of Criminal Justice Planning for funding of the Career Criminal
Prosecution Unit for the period of July 1, 1997 through June 30, 1998, in the amount of$170,070 (state funds).
Il. FINANCIAL IMPACT
This grant contract will be in the amount of$170,070 to fund salaries and benefits for two lawyers who staff the
Career Criminal Prosecution Unit, which is located in the Office of the District Attorney, Budget Unit No. 0242,
Organization No. 2844. Expenditures and revenues for this project are included in the District Attorney's 1997/98
budget.
III. REASONS FOR RECOMMENDATION/BACKGROUND
The Career Criminal Prosecution Unit handles felony cases committed by professional criminals who have made
a career out of crime. Repeat offenders who commit serious crimes such as robbery, burglary (first and second
degree), grand theft, receiving stolen property, and lewd acts on children are being prosecuted by this unit. The
legislation for this program requires the District Attorney's Office to use experienced felony trial deputies who are
assigned reduced caseloads and who are required to handle the case on a vertical prosecution basis from the time
of arraignment continuing through final sentencing in superior court, including all intervening motions. Continued
funding of this grant by the State is contingent upon the County prosecuting these cases as provided within the
statues.

In the first six months of the grant period July 1, 1996 to December 31, 1996, the unit prosecuted career criminals
reaching the disposition stage. All convictions resulted in a sentence to state and a few local institutions.
IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to approve this recommendation would result in the inability of the District Attorney to apply for $170,070
in State funds available to prosecute repeat offenders who commit serious crimes such as robbery, burglary, and
lewd conduct with children in the County. Since these funds have been built into the District Attorney's 1997/98
revenue budget, disapproval of the recommendation would create a revenue shortfall of that amount.

RESOLUTION OF THE GOVERNING BOARD 97/ 486
WHEREAS the County of Contra Costa desires to undertake a certain project designated Career Criminal
Prosecution Unit, to be funded, in part, from funds made available through the Career Criminal Prosecution
Program administered by the Office of Criminal Justice Planning (hereinafter referred to as OCJP).
NOW, THEREFORE, BE IT RESOLVED that the District Attorney of Contra Costa County, is authorized, on its
behalf, to submit the proposal to OCJP and is authorized to execute, on behalf of the Board of Supervisors of
Contra Costa County, the Grant Award Agreement, including any extensions or amendments thereof.
IT IS AGREED that any liability arising out of the performance of the Grant Award Agreement, including civil
court actions for damages, shall be the responsibility of the grant recipient and the authorized agency. That
State of California and OCJP disclaim any responsibility for any liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditures
controlled by this body.
