( 1982 Uniform Mechanical Code Adopted &
Grading Permit Fee)
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I: Chapters 710-2 and 710-4 of the County Ordinance Code
are amended , to adopt the 1982 Uniform Mechanical Code, to read:
CHAPTER 710-2 ADOPTING UMC
710-2.002 Adoption. (a) The mechanical (heating, ven-
tilating, cooling, etc. ) code of this county is the 1982 edition
of the Uniform Mechanical Code (including appendices) adopted
jointly by the International Association of Plumbing and
Mechanical Officials and the International Conference of Building
Officials.
(b) ' This uniform code, with the changes, additions, and dele-
tions set forth in this division, is adopted by this reference as
though fully set forth in this division.
(c) Three copies of this uniform code are now on file in the
office of the clerk of the board; and the other requirements of
Government Code Section 50022.6 have been and shall be complied
with.

CHAPTER 710-4 MODIFICATIONS
ARTICLE 710-4. 1 GENERAL
710-4 . 101 General . The 1982 Uniform Mechanical Code adopted
by reference in Section 710-2.002 shall be effective in this
county with the changes , additions, and deletions set forth in
this chapter, and as modified by the provisions of this division.
Where indicated by the context , chapter and section numbers used
in this chapter are those of the Uniform Mechanical Code (UMC) .

ARTICLE 710-4.2 UMC CHAPTER 2
310-4.202 UMC Sec. 201 (h) liability. Uniform Mechanical
Code Section 201 (h) is amended to read:

" (h) Liability of County andEmployees .
This division shall not be construed to impose
on this county any liability or responsibility
for damage resulting from defective appliances;
nor shall this county or any official or
employee of this county be held to assume any
liability or responsibility by reason, of the
inspection authorized by this Division."

710-4 .204 UMC Secs . 203 and 204 , violations appeals.
Uniform Mechanical Code Sections 203 and 20 aredeleted.

ARTICLE 710-4.3 UMC CHAPTER 3
710-4.301 UMC Sec . 302(d) , permittees . Anew subsection (d)
is added to'UMC Section 302 on permits , to read:
" (d) Who Can Get Permit . A permit for
the erection, installation, moving, alteration,
-repair , or replacement of any heating or cooling
equipment shall be issued only to:
" ( 1 ) A person holding a valid
California State Contractor's license as
a Warm Air Heating, Ventilating, Air
Conditioning or General Building Contractor ,
or
" (2) An owner who personally or
only by duly qualified employees shall do
the work for which the permit is issued ."

710-4 .303 UMC Sec. 304 , fees . Uniform Mechanical Code
Section 3041 on fees is deleted , because superseded by Article
710-1 .3.

710-_4 .305 UMC Sec. 307, approval certificate. A new UMC
Section 307 is added , to read:
"Sec. 307 . Certificate of Approval . No
heat pro—duces equipment regulated by this
division shall be connected to the fuel supply
until it complies with all applicable require-

ments of this division and a certificate of
approval in writing has been issued by the
Building Inspection Department .
The requirements of this section shall
not be deemed to prohibit the operation of any
heating equipment installed to replace defective
heat producing equipment serving an occupied
portion of a building, if a request for inspection
of the equipment has been filed with the Building
Inspection Department at least one departmental
work day before the replacement work :is completed
and before any portion of the equipment is con-
cealed by any permanent portion of the building."

ARTICLE 710-4.4 UMC CHAPTER 4
710-4.401 UMC Sec. _420, ready access . Uniform Mechanical
Code Section_1�20 iis_amended by changing the following definition
to read:
"'Readily accessible' means capable of being
reached safely and quickly for operation, repair,
or inspection without requiring those to whom
ready access is requisite to climb over or remove
obstacles , or to resort to portable ladders , chairs ,
etc . Valves or similar controls which are in-
frequently serviced are to be considered "readily
accessible' if they may be serviced from a safety
hooked or otherwise stable portable ladder."

ARTICLE 710-4.21 UMC CHAPTER_21L APPENDIX B
710-4.2103 UMC Appendix BL_boilers. Uniform Mechanical Code
Chapter 217Appendix B _on Boilers and Hot Water Piping is amended
by deleting the second and third paragraphs of' Section 21239 and
deleting Sections 2124, 2125, and 2126.

SECTION II . Section 716-4. 1014 is amended , to increase the
gi^a7fng permit investigation fee , to read:
716-4.1014 Site investigation and evaluation. A site
investigatr—
on and evaluaffon fee of thirty dollars shall be paid

when a site investigation and evaluation is requested prior to
application for a grading and/or building permit.

SECTION III . EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within 15 days after passage shall be
published once with the names of supervisors voting for and
against it in the MARTIMEZ NEWS-GAZETTE , a newspaper
published in this County.
PASSED and ADOPTED on October 25. 1983 , by the following
vote:
AYES: Supervisors - Powers, Fanden, McPeak, Torlakson,
NOES: Supervisors None.
ABSENT: Supervisors = Schroder.
ABSTAIN: Supervisors - None.

SUBJECT: Hearing on a Proposed Ordinance
Supervisor Toriakson, Vice Chair, serving as Chair in the absence of Supervisor Shcroder, having
convened the hearing on the proposed ordinance to adopt by reference the Uniform Mechanical Code, 1982
Edition,to increase grading permit investigation fees; and
The Chair having invited persons to speak on the proposed ordinance under consideration; and
Speakers having commented on the need for the fee increase and the impact on development and the
consumer; and
All persons desiring to speak having been heard;
THEREFORE, IT IS BY THE BOARD ORDERED that the hearing is CLOSED .
IT IS FURTHER ORDERED that Ordinance No. 83-59 is ADOPTED which adopts by reference the
Uniform Mechanical Code, 1982 Edition, increasing grading permit investigation fees.

convened the hearing on the proposed ordinance that would require installation of additional swimming pool
fencing; and
The Chair having invited persons to seak on the proposed ordinance under consideration; and
Speakers having commented on the pros and cons of enacting such an ordinance, the additional
expense on the purchaser of a new in-ground swimming pool while current pool owners are exempt,
consideration for requiring an audible alarm in lieu of additional fencing around the pool, the aesthetics of the
additional fencing, and a proposal to exempt new pool owners who do not have children in their households
from the additional fencing requirement.
All persons desiring to speak having been heard;
IT IS BY THE BOARD ORDERED that the hearing is CLOSED.
IT IS FURTHER ORDERED that the proposed ordinance to require installation of additional swimming
pool fencing is REFERRED to the Internal Operations Committee for review.
