RECOMMENDATION:
AUTHORIZE the Chair of the Board to sign letters to Senator Mike Thompson,
Governor Pete Wilson, Senator Richard Rainey, Senator Barbara Lee,
Assemblywoman Dion Aroner and Assemblyman Tom Torlakson for their support of
SB 154.
BACKGROUND:
SB 154 was introduced by Senator Mike Thompson on January 15, 1997. The
Board of Supervisors voted on February 11, 1997 to support SB 154. SB 154, as
amended May 23, 1997, permits any board of supervisors to impose a sales tax of
either 1/8¢ or Y4¢ if the ordinance imposing the sales tax meets all of the following
conditions:
✓ The ordinance is placed on the ballot and is approved by 2/3 of the voters
voting on the ordinance.
✓ The ordinance includes an expenditure plan describing the specific purposes
for which the revenues from the tax may be spent.
✓ The tax is imposed at a rate of either 1/8¢ or Y4¢ for a period not to exceed 16
years.

In voting no on the motion, Supprvisor Gerber stated that she appreciated the intent of the motion,
however, she could not reconcile expressing gratitude to Governor Wilson for signing the Library
Sales Tax Legislation SB154 (Thompson) given the current State Budget situation and the resulting
fiscal impacts facing Contra Costa County.

✓ The revenues collected are used only for specified library construction,
acquisition, programs and operations.
✓ The revenue supplements existing expenditures for public library services.
Supplanting is prohibited.
✓ The tax conforms to existing law regarding the imposition and collection of the
sales and use tax.
SB 154 passed the Senate initially on March 20, 1997 by a vote of 25:3. It passed
the Assembly in a slightly modified version on June 30, 1997 by a vote of 49:21.
The Assembly amendments were concurred in by the Senate on July 3, 1997 by a
vote of 25:6. The bill was signed by the Governor on July 21, 1997 and is now
Chapter 88, Statutes of 1997.
In view of the Board's previous support for the bill, it seems appropriate for the Board
to express its thanks to Senator Thompson for carrying the bill, to the Governor for
signing the bill and to those members of our delegation who voted for the bill,
thanking them for their support.

An act to add Chapter 2.98 (commencing with Section
7286.59) to Part 1.7 of Division 2 of the Revenue and Taxation
Code, relating to taxation.
LEGISLATIVE COUNSEL'S DIGEST
SB 154, as amended, M. Thompson. Transactions and use
taxes: counties: public libraries.
Existing law authorizes various local governmental entities,
in accordance with certain requirements and limitations, to
levy transactions and use taxes pursuant to the Transactions
and Use Tax Law.
This bill would additionally authorize the board of
supervisors of a county to impose a transactions and use tax at
a rate of 0.125% or 0.25% by the adoption of an ordinance, as
specified, if certain conditions are met. Revenues from the tax
could be used only for funding public library construction,
acquisition, programs, and operations within the county, as
provided.
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.

The people of the State of California do enact as follows:
1 SECTION 1. Chapter 2.98 (commencing with
2 Section 7286.59) is added to Part 1.7 of Division 2 of the
3 Revenue and Taxation Code, to read:

5 CHAPTER 2.98. COUNTY TRANSACTIONS AND USE TAX FOR
6 LIBRARY PROGRAMS

8 7286.59. (a) In addition to the tax levied pursuant to
9 Part 1.5 (commencing with Section 7200) , and any other
10 tax authorized by this part, a board of supervisors of a
11 county may impose a transactions and use tax in lieu of,
12 and not in addition to, a tax imposed under Section 7285.5
13 for the purposes described in paragraph -(-G} (4), by the
14 adoption of an ordinance in accordance with this part if
15 each of the following conditions are met:
16 (1) The ordinance imposing the tax is submitted to and
17 approved by the voters of the county by a two-thirds vote
18 of those voters voting on the ordinance in accordance
19 with Article 3.7 (commencing with Section 53720) of
20 Chapter 4 of Part 1 of Division 2 of Title 5 of the
21 Government Code.
22 (2) The ordinance includes an expenditure plan
23 describing the specific purposes for which the revenues
24 from the tax may be expended.
25 (3) The taxis imposed at a rate of 0.125 or 0.25 percent
26 for a period not to exceed 16 years.
27 (4) The revenues collected from the tax are used only
28 for funding public library construction, acquisition,
29 programs, and operations within the county. These
30 revenues shall be used only to supplement existing
31 expenditures for public libraries and shall not be used to
32 supplant existing funding for the support of public
33 libraries.
34 (5) The transactions and use tax conforms to Part 1.6
35 (commencing with Section 7251) .
36 (b) "Public library" means a library, or two or more
37 libraries that are operated as a single entity by one or
38 more public jurisdictions, that serve the general public
