This ordinance amends section 416-4 . 604 "Penalties" to provide that violation of section 416-4 . 404 "Abandonment" is a misdemeanor and pubishable as such. SECTION II . Section 416-4 . 604 is amended to read as shown on the attached ordinance . Re: Proposed ordinance amending ordinance section 416-4.604 "Penalties" Attached please find a proposed ordinance which would amend Ordinance section 416-4.604 "Penalties" to provide that abandonment of an animal is punishable as a misdemeanor. This proposed ordinance is recommended by Supervisor Canciamilla and the Animal Services Department. Please arrange for placement of this proposed ordinance on the Board of Supervisors agenda. MAMNam attachment cc: Supervisor Canciamilla Mike Ross, Acting Director, Animal Services Department ORDINANCE NO. 97- (Penalty for Abandonment of Animal) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code). SECTION I. SUMMARY. This ordinance amends section 416-4.604 "Penalties" to provide that violation of section 416-4.404 "Abandonment" is a misdemeanor and punishable as such. SECTION II. Section 416-4.604 is amended to read: 416-4.604 Penalties. (a) Notwithstanding Section 14-8.004, and pursuant to Food and Agriculture Code § 31401, violations of Division 416 of this code, excepting Chapter 416-10 and Article 416-12.2, are punishable by a fine of not more than fifty dollars for the first offense, and not more than one hundred dollars for the second or subsequent offense. (b)Notwithstanding subsection (a) above, violation of section 416-4.404 Abandonment, excluding abandonments under section 416-8.014, is a misdemeanor and punishable as such. (Ords. 97- §2; 80-97). SECTION III. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the , a newspaper published in this County. City of Brentwood 708 Third Street Brentwood, CA 94513 Dear Mr. Corey: The Contra Costa County Board of Supervisors will consider adopting the enclosed amendment to the Animal Control Ordinance at its meeting of August 12, 1997, at approximately 10 a.m. The contract between the County and the cities requires that contracting cities adopt the County Animal Control Ordinance and any amendments thereto. Therefore, if this amendment is adopted by the Board of Supervisors your city will also have to adopt the amendment. This change to the Animal Control Ordinance will increase the penalties for those individuals convicted of abandoning their animals. This is an issue that appears to have widespread support. Adoption of this Ordinance amendment should increase the awareness of the public as to their responsibilities relative to the animals they keep as pets. Please contact me if you have any questions.
