RECOMMENDED ACTION: APPROVE Project, and FIND, on the basis of the initial study and all comments received, that there is no substantial evidence that the project will have a significant effect on the environment, ADOPT the Negative Declaration in compliance with the California Environmental Quality Act, (the custodian of which is the Public Works Director who is located at 255 Glacier Drive, Martinez) and DIRECT the Public Works Director to begin right of way acquisition and to prepare contract plans and specifications for construction. FINANCIAL IMPACT: The estimated project cost is $532,000, funded by Federal Highway Bridge Rehabilitation and Replacement (HBRR) (80%) and Local Road Funds (20%). III. REASONS FOR RECOMMENDATION/BACKGROUND: The project includes removing and replacing the existing bridge across Mt. Diablo Creek. It is needed to replace a structure that Caltrans has rated as deficient in width and load capacity. The project has been determined to be in compliance with the General Plan. A Negative Declaration of environmental significance pertaining to this project was published with no protest, and the Board has considered the negative declaration together with all comments received during the public review period. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of design and construction and may jeopardize funding. Location: Bailey Road Bridge is proposed to be located on Bailey Road in the Concord area of Contra Costa County. Project Description: The project involves replacing the existing two-lane, 22-foot wide, 31-foot long, bridge with a new two-lane, 32-foot wide, 40-foot long, reinforced concrete slab structure in approximately the same location as the existing bridge. Minor striping will allow the existing 11-foot wide lanes of Bailey Road fo meet the 12-foot wide lanes of the new bridge. Existing roadside drainage ditches will be modified to drain the realigned roadway and to continue discharging into Mt. Diablo Creek. Overhead utility lines will need to be relocated as well as two utilities located on the bridge itself. Findings of Exemption: Pursuant to CEQA Guidelines Sections 15162-15164 & 15168 (c)(2) and on the basis of a written checklist, no additional CEQA document need be prepared. Based on a review of the previous Initial Study and Negative Declaration, a field visit, and project description, no new subsequent changes are proposed; no substantial changes with respect to the circumstances under which the project is to be undertaken have occurred; and, no new information of substantial importance has become available. An Initial Study was conducted to evaluate the potential for adverse impacts and considering the record as a whole, there is no evidence that the proposed project will have a potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Based on substantial evidence, the County of Contra Costa rebuts the presumption of adverse effect as listed at subsection (d) of Section 753.5 of the Fish and Game Code. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute the State "Local Streets and Roads Program Supplement No. 113" which provides $265,590 in Federal Funds to study alternatives for the seismic retrofitting of bridges on Del Monte Drive, Hawthorne Drive, Pacific Avenue, and Freeman Road. II. Financial Impact: The supplement provides Federal reimbursement for 90% of the County's costs for this project. State seismic funds will provide the remaining 10% of the funding for this project. There is no impact to the County's General Fund. 111. Reasons for Recommendations and Background: On June 21, 1977 the Board approved County/State Master Agreement No. 04-5928 for the funding of Federal Aid Projects. On May 24, 1994, Contra Costa County qualified for Federal funds to pay for the work specified. IV. Consequences of Negative Action: If this program supplement is not approved, the County will have to orb the entire cost of the seismic retrofit study. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2 . All required signing and marking at railroad crossing will be completed in accordance with the requirements of MUTCD, 1978 . 3 . The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /Detail Estimate or its modification (PR-2A) or the FNM-76, and accepts any increases in Exchange Funds, State Matching funds, ,and\or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 4 . State Seismic funds will provide the match to Federal Funds, as well as Local Agency overhead costs, relating to seismic project development until June 30, 1998 . 7. The Local Agency agrees to use local funds to match that portion of the work not eligible for match under The State Seismic Program. B . In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 9 . Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub-contractor incurring over $25, 000 on the project . The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22, Allowable Costs . Reasons for Recornmendation and Backuround: Subsurface Consultants Inc. has been providing miscellaneous soils investigations for various County projects in accordance with their agreement. One of these projects has been to provide in place soil characterization for the Laurel Road Study in the Oakley area. It is necessary to increase the payment limit by $10,000 to cover the remaining work. IV. Consequences of Negative Action: Negative action would require the Public Works Department to hire a new consultant at additional cost which would also delay the project.
