OPEN THE PUBLIC HEARING and receive testimony on the Rodeo Downtown/Waterfront General Plan Amendment and the related Rodeo Specific Plan concurrently. 2. CERTIFY that the Final Environmental Impact Report is adequate and complete, has been prepared in compliance with State and County CEQA Guidelines, and that the Board has considered the contents of the report prior to making a decision on this project. 3. CLOSE THE PUBLIC HEARING and declare your intent to APPROVE the Rodeo Downtown/Waterfront General Plan Amendment and ADOPT the Rodeo Specific Plan subject to the adoption of the Statement of Findings/Overriding Considerations and the Draft Mitigation Monitoring Program. 4. Direct staff to return on August 12, 1997 with the Draft Statement of Findings and Overriding Considerations and the Draft Mitigation Monitoring Program for the Board's adoption. FISCAL IMPACT Covered by the Community Development and Redevelopment Agency budgets. The approximately 90 acre area runs along the San Pablo Bay Shoreline from the Hercules City limits line on the southwest, to the Unocal Refinery on the northeast. Inland it has a varied boundary along Second Avenue to Harris Avenue, north to First Street, southerly adjacent to Pacific Avenue to Rodeo Avenue, east to Fourth Street, then north along Rodeo Creek and Railroad Avenue back to San Pablo Avenue and north to the Unocal Refinery. The Rodeo Downtown Waterfront Specific Plan (County File #SP 95-0002) covers the area described for the General Plan Amendment. Jim Kennedy, Deputy Director of the Redevelopment Agency, presented the staff report. He advised that Agenda Items C.90 and D.6 should be also considered with this matter, and he noted that the Rodeo Redevelopment Advisory Committee recommended that properties on the water side of San Pablo Avenue, approximately between the Parker Avenue curve to Railroad Avenue extended, be designated for mixed use in the General Plan rather than Commercial Recreation, but that the property would not be appropriate for residential use. Supervisor Rogers questioned whether consideration had been given for the property's proximity to Tosco when requesting the mixed use designation. There was no response. The public hearing was opened, and Tom Gazzano, 2425 San Pablo Avenue, Pinole, commented on the issue. All persons desiring to speak having been heard, the hearing was closed. Supervisor Uilkema stated that these actions were long-awaited, and they demonstrate what positive action can happen when a community works together. She moved that the two properties under consideration ( Identified on attached C.90 [3] ) be designated for mixed use, as part of the redevelopment area, but not for residential use. Supervisor Rogers seconded the motion. On July 22, 1997 the Board of Supervisors will be considering adoption of a General Plan Amendment and a Specific Plan for the Rodeo Downtown/Waterfront. The County Planning Commission has recommended adoption of a Specific Plan substantially as recommended by the Rodeo Redevelopment Advisory Committee. The Planning Commission recommendation differed in one respect: it recommended that properties on the outboard (water) side of San Pablo Avenue between roughly the Parker Avenue curve to Railroad Avenue extended be designated as mixed use in the General Plan rather than Commercial Recreation(which the current General Plan and the Rodeo Redevelopment Advisory Committee's recommended General Plan provided for). (Map A-1 reflects the County Planning Commission recommendations,and May A-2 reflects the recommendation of the Rodeo Redevelopment Advisory Committee.) The Rodeo Redevelopment Advisory Committee is concerned that this change could introduce residential uses via the mixed use land use designation onto properties that are not appropriate for residential use. We would respectfully request that text be added to the General Plan and Specific Plan that stipulates residential uses on the outboard(water)side of San Pablo Avenue between Pacifica Avenue to the Sanitary District access road are not permitted.
