RECOMMENDATIONS
ADOPT the following findings pursuant to Section 33445 of the State of California Health and Safety
Code as the Board of Supervisors and the Governing Board of the Redevelopment Agency based on the
analysis set forth in the attached Basis For Findings: (1) the park improvements are of benefit to the
Oakley Redevelopment Project Area or to the immediate neighborhood in which the improvements are
located; (2) that there are no other reasonable means of financing the park available to the County; and
(3)that Agency payment of funds for the development of the improvements will assist in the elimination
of one or more blighting conditions inside the Project Area and is consistent with the Agency's
Implementation Plan.
AUTHORIZE the Deputy Director-Redevelopment to execute a Development Agreement with
Ecumenical Association for Housing to develop a park in the Oakley Redevelopment Project Area.
FISCAL IMPACT
No impact on the General Fund. The total cost is$200,000 and would be funded from the capital portion
of bond proceeds. This appropriation was provided for in the Agency's 1996-97 adopted budget.

BACKGROUND/REASONS FOR RECOMMENDATIONS
A major goal of the Oakley Redevelopment Plan is to construct or rehabilitate public facilities in the
Project Area. The Oakley Municipal Advisory Council has considered and recommended the above
action.

BASIS FOR FINDINGS PURSUANT TO SECTION 33445 OF
THE STATE OF CALIFORNIA HEALTH AND SAFETY CODE
I. Summary Of The Program.
The Contra Costa County Redevelopment Agency (the "Agency") is proposing to finance
the acquisition and development of a Park (the "Park") in the Oakley Redevelopment Project Area
(the "Project Area"). The Park is proposed to be located on a parcel on the south side of State
Route 4 and west of Gardenia Avenue which is within the Project Area boundary, as more
particularly described in Exhibit A attached to this report (the "Site"). The Park will be owned and
operated by the County of Contra Costa("County"). Under this Agreement, the Agency would
provide two hundred thousand ($200,000) Dollars for the acquisition and construction of the
Park.
The Site on which the Park will be constructed is vacant and is located on State Route 4,
west of Gardenia Avenue. The Site is part of a larger parcel (the"Combined Property") being
acquired by Ecumenical Association for Housing ("EAH"), a nonprofit housing developer, to
construct a twenty-four (24) unit affordable housing project for lower income disabled persons.
The Combined Property was considered about one-half acre too large for the housing project.
EAH, the Agency, and the Oakley community explored alternative development opportunities for
the Site after its separation from the Combined Property. Improving the Site as a park was
preferred by all parties to provide an entranceway and enhance the downtown business district of
Oakley. The Agency intends to provide the funds for the acquisition and development of park
facilities. EAH will be responsible for development of the park facilities and upon satisfactory
completion, the Park will be conveyed to the County.
Pursuant to Health and Safety Code Section 33445, the Agency is authorized, with the
consent of the County, to pay part or all of the value of Park acquisition and improvements which
are to be publicly owned and are of benefit to the Project Area. The County must determine (a)
that the public improvements are of benefit to the Project Area or to the immediate neighborhood
in which the improvements are located, (b) that there are no other reasonable means of financing
the public improvements available to the County; and (c) that Agency payment of funds for the
development of the improvements will assist in the elimination of one or more blighting conditions
inside the Project Area and is consistent with the Agency's Implementation Plan.
II. Estimate Of The Amount Of Tax Increment To Be Used By The Agency For The
Construction Of The Park.
Under the Agreement, the Agency would pay two hundred thousand ($200,000)Dollars
of tax increment funds to acquire and develop the Park.
III. Facts Supporting The Findings To Be Made Pursuant To Health And Safety Code Section
33445.
A. Facts Supporting The Finding That The Park Is Of Benefit To The Project Area
Or The Immediate Neighborhood In Which The Project Is Located.
Development of the Park is of benefit to the Project Area because it will do following:
I. As described in the documents set forth in Exhibit B (in particular, Part IV,
Subsection C of the Redevelopment Plan), the Project Area is characterized by the
existence of the following blighting influences that have a detrimental physical and
economic impact on surrounding parcels, inadequate public improvements, open
space, and recreation facilities. The Park contributes to the elimination of these
blighting influences because the Park will provide public and recreation
improvements that are safe for Project Area residents and will expand or preserve
the community's supply of public, park and recreational facilities.
2. Enhance the Project Area with improvements and recreational facilities that serve
as a catalyst for private development of nearby parcels and portions of the Project
Area.
B. Facts Supporting The Finding That There Are No Other Reasonable Means Of
Financing The Park Available To The County.
There is a financing gap between the overall development costs of the Park and the
County resources available to develop the Park. County General Funds are not considered a
feasible source of gap financing because there is a higher priority for the County to fund essential
needs such as social, public health, and safety services. Community Development Block Grant
funds are also not considered a feasible source of gap funding because there is higher priority for
the County to fund affordable housing, economic development, and social service programs. Park
Dedication funds were also considered infeasible as the funds available for the Oakley area are
earmarked for other projects. Special District Assessment funds are not considered a feasible
source of funding because property owners are being asked to approve an assessment for open
space maintenance and several other special assessments are being considered to fund other
special projects. In addition, development of the Park is not a condition of approval of any
private development. Thus, there is no private source of funds that are theoretically or realistically
available to fund the Park. Therefore, the Agency's participation is the only reasonable means of
financing the Park available to the County.
C. Facts Supporting The Finding That Agency Funding The Development Of The
Park Will Assist In The Elimination Of One Or More Blighting Conditions Inside
The Project Area And Is Consistent With The Agency's Implementation Plan.
1. The facts supporting the findings that Agency funding of the Park will assist in the
elimination of blighting conditions inside the Project Area are as follows:
(a) As described in the documents set forth in Exhibit B (in particular, Part IV,
Subsection C of the Redevelopment Plan), the Project Area is characterized by the
existence of the following blighting conditions that have a detrimental physical and
economic impact on surrounding parcels, inadequate public improvements, open
space, and recreation facilities. The Park contributes to the elimination of these
blighting conditions because the Park will provide public and recreation
improvements that are safe for Project Area residents and will expand or preserve
the community's supply of public, park and recreational facilities.
(b) Enhance the Project Area with improvements and recreational facilities that serve
as a catalyst for private development of nearby parcels and portions of the Project
Area (and consequent elimination of other blighting conditions).
2. The facts supporting the findings that Agency funding of the Park is consistent
with the Agency's Implementation Plan.
As described in Part VII, Goal 2, and Objective 5 of the Implementation Plan (as
described in the attached Exhibit B), the Agency's funding of the development of the Park will
eliminate blighting conditions by providing public and recreation improvements that are safe for
Project Area residents and will expand or preserve the community's supply of public, park and
recreational facilities
IV. Agency Funding Of The Acquisition And Development Of The Park Is Provided For In
The Redevelopment Plan.
The Redevelopment Plan provides that the Agency can assist in the financing and
construction of park and recreational facilities (as detailed in Part IV, Subsection C, Objective 2
of the Redevelopment Plan). As described in the documents set forth in Exhibit B, the Project
Area is characterized by the existence of the following blighting influences that have a detrimental
physical and economic impact on surrounding parcels, inadequate public improvements, open
space, and recreation facilities. The Park contributes to the elimination of these blighting
conditions because the Park will provide public and recreation improvements that are safe for
Project Area residents and will expand or preserve the community's supply of public, park and
recreational facilities as explicitly provided for in the Redevelopment Plan.
