Martinez,Executive Director DATE: September 24, 1996 SUBJECT: ADOPT RESOLUTION APPROVING REVISIONS TO THE PROCUREMENT POLICY SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: ADOPT Resolution No. 3788 approving revisions to the Procurement Policy of the Housing Authority of the County of Contra Costa,and AUTHORIZE the Executive Director of the Housing Authority to submit certification to HUD that the revised Procurement Policy has been approved by the Board of Commissioners of the Housing Authority of the County of Contra Costa as mandated in a HUD Notice received August 23, 1996. II. FINANCIAL IMPACT: NONE III. REASONS FOR RECOMMENDATIONBACKGROUND The Housing Authority has received notification from the U.S.Department of Housing and Urban Development(HUD) requesting all Public Housing Authorities(PHAs)to review and,if necessary,revise their procurement policies in accordance with 24 CFR Part 85.36 and submit certification that the revisions have been completed by September 30, 1996. The small purchase threshold has been increased from$25,000 to$100,000,affecting procurement. As a result,unless a lower amount is required by State or local law,or the Housing Authority's own procurement policy,the Housing Authority may use small purchase procedures to secure services, supplies,or property that do not cost more than$100,000. If small purchase procedures are used,the Housing Authority shall obtain price or rate quotations from and adequate number of qualified sources,usually at least three. The Housing Authority has revised their Procurement Policies in accordance with 24 CFR Part 85.36,and a copy is attached for your review. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect not to adopt Resolution No. 3788,the Housing Authority would not be in compliance with the HUD mandate to revise the Procurement Policy. ATTESTED September 24 , 1996 PHIL BATCHELOR,CLERK OF THE BOARD OF COMMISSIONERS AND COUNTY ADMINISTRATOR BU DEPUTY bo-acc RESOLUTION NO. 3788 ADOPTING REVISED PROCUREMENT POLICY WHEREAS, HUD Information Bulletin received August 23, 1996, requires all Public Housing Authorities (PHAs)to review and if necessary, revise their procurement policies in accordance with 24 CFR Part 85.36; to increase the small purchase threshold from$25,000 to $100,000 and, WHEREAS, the Department of Housing and Urban Development has determined that each housing authority must adopt procurement policy revisions made, and submit certification that the revisions have been completed by September 30, 1996; NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Housing Authority of the County of Contra Costa hereby adopts the revised Procurement Policy, Section 3.0, increasing the small purchase threshold from $25,000 to $100,000. Said revision is to become effective immediately subject to HUD review and approval.
