REASONS FOR RECOMMENDATION San Francisco-to-Stockton (Baldwin) Ship Channel Contra Costa County has historically supported the deepening of sections of the San Francisco-to-Stockton Ship Channel Project and is the local sponsor for the Project. Originally a five-phase endeavor, the last section remaining to be dredged is the third phase, roughly extending.from the Richmond area north and east, essentially to Avon, east of the Martinez-Benicia bridge. Deepening of sections of this channel from -35 to-45 feet would require dredging and disposal of 9 million cubic yards of sediments, and was at one time delayed because of the many questions associated with salinity intrusion into the Delta area. Environmental concerns and the extreme amount of physical and numeric modeling (attempts to determine salinity impacts), coupled with the massive amount of material to be dredged and disposed, has resulted in the upward spiraling of costs of the project (which could go as high as $150 million). The local cost share would total 35% of project costs, which has been planned to be paid by the project's beneficiaries, which in this instance are the oil industries in Contra Costa and Solano Counties. Recent closure of the Point Molate Fuel Depot in the Richmond area, coupled with the availability of a PG&E pipeline extending from Richmond to Antioch, has provided a viable alternative, which Wickland has pursued. Wickland has purchased the PG&E pipeline, has established pipeline links with the other refineries, and is working with the Port and City of Richmond on suitable possibilities for a pier and tankage near the shoreline. County staff has worked with Wickland and the Corps on inclusion of the marine pipeline link as an alternative to channel deepening as outlined in the draft EIS/EIR on the project, as it offers great reductions in environmental effects and the amount of material to be dredged (less than 1 million cubic yards), as well as significant resultant cost reductions. The pipeline would be utilized by any or all of the oil industries, via the common-carrier approach, overseen by the Public Utilities Commission. This alternative would also have the desired effect of reducing or eliminating the lightering (off loading) of vessels in San Francisco Bay, a goal of the original deepening project. Reconnaissance Studies for deepening of San Francisco Bar Channel and Southampton Shoal Channel Reconnaissance study by the Corps to determine need for additional deepening and/or widening of the Southampton Shoal and the San Francisco Bar Channel has been planned for some time, and $100,000 has been allocated by Congress for the 1997 fiscal year. Southampton was deepened to -45 feet as part of the Baldwin project, but the bar pilots have indicated safety concerns due to tidal currents, making the turn at Angel Island very difficult as they proceed north toward San Pablo Bay. Greater tidal influence at the San Francisco Bar Channel results in less operational flexibility and time constraints for the larger ships as they navigate through this area. County staff has worked with our County legislative delegation to enable reconnaissance studies in these areas to proceed. The Marine Pipeline link alternative, if implemented, would reduce the amount of material needing to be dredged as part of the Baldwin deepening project. However it becomes important for deeper water to be available to enable ship travel to the proposed off-loading facility in Richmond. Additional deepening at Southampton Shoal, and the San Francisco Bar to some extent, will allow the necessary ship transport and off-loading flexibility. Long Term Management Strategy for Dredging (L TMS) Due to what has been termed as "mudlock", (or the inability to move forward with dredging and disposal projects to the detriment of industry and the economy within the Bay area), the Agencies involved in permitting activities have gotten together with the intent of providing a streamlined approach to dredging and disposal. The US Environmental Protection Agency (EPA), the US Army Corps of Engineers (Corps), the San Francisco Regional and State Water Resources Control Boards, and the Bay Conservation and Development Commission (BCDC) have met since 1990 in an attempt to move beyond the number of problems plaguing the dredging community which have resulted in multi-year delay on some dredging projects. A draft policy Environmental Impact Statement/ Report has recently been released, entitled LTMS for the Placement of Dredged Material in the San Francisco Bay Region. County staff commented on the Report and has been following the issue, along with a great number of organizations and agencies which have been involved at various levels. Formal goals established by the LTMS Executive Committee listed in the draft report include; dredging and maintenance of necessary channels in an economically and environmentally sound manner, environmentally sound disposal policies, maximizing reuse of dredged material, and a cooperative permitting scenario. This would entail coordination of agencies, identification of an array of disposal sites, promotion of upland disposal options for reuse and revision of dredging protocols. RRG4:9-24wc2.6bd a n •. Development of this system would significantly reduce the volume of tanker traffic in the Richmond to Martinez/Benicia shipping corridor, while at the same time virtually eliminating the need for vessel-to-vessel crude oil lightering in San Francisco Bay. The major components of the proposed project are: 1. A new single berth deep water wharf facility (approximately 53' draft) located in the Port of Richmond capable of handling crude oil tankers up to 300,000 deadweight tons in size. It is estimated that the wharf will be visited by a tanker every 5-7 days once the pipeline system is placed into operation. Each tanker visit will typically last about 24 hours. 2. A new large diameter pipeline system connecting the wharf to a terminal located in the Port of Richmond comprised of new, state of the art storage tanks, with a total storage capacity of 1.5 million barrels. 3. A new connecting pipeline approximately 3.5 miles in length running east from the new Richmond terminal to an existing petroleum pipeline Wickland has contracted to purchase from Pacific Gas and Electric Company ("P.G.&E. ") 4. An existing pipeline approximately 38 miles in length running from Richmond, California to the P.G.&E. Delta Power Plant located in Pittsburg, California. Wickland has contracted to purchase the pipeline from P.G.&E. The line was built in the mid 1970s and includes a pumping station with 850,000 barrels of storage capacity located in Hercules, California. All portions of the existing line are either 12" or 16" in diameter. A geographic overview of the routes of the pipeline system are further detailed on the enclosed map. The pipeline system will be operated by a state of the art computerized Supervisory Control and Data Acquisition System ("SCADA") . The SCADA system will be located at, and operated out of, Wickland's existing Martinez terminal. Live backup control stations will be located in Hercules and Richmond. The pipeline system will include leak detection systems and cathodic protection, and will be subjected to a rigorous preventative maintenance program including but not limited to regular pressure testing as well as both internal and visual inspections. 5/20/96 It is anticipated that the pipeline system being proposed by Wickland will operate at a capacity of approximately 165,000 barrels per day, and will be capable of serving virtually all East Bay refineries and terminals, including: The Chevron Refinery located in Richmond. The Pacific Refinery located in Rodeo. The UNOCAL Refinery located in Rodeo. The Wickland Terminal located in Crockett. The Shell Refinery located in Martinez. The Wickland Terminal located in Martinez. The Tosco Refinery located in Martinez. The Exxon Refinery located in Benicia. The P.G.&E. Powerplant located in Pittsburg. The pipeline system will operate as a common carrier system regulated by both the California Public Utilities Commission and the Federal Energy Regulatory Commission. Wickland is currently in the process of filing for regulated common carrier pipeline status with both of these entities. It is anticipated that the Port/City of Richmond will derive revenue from the pipeline system in three different ways: * A per barrel tariff for every barrel of petroleum handled over the wharf. * Regular lease payments for land upon which the new terminal tank farm will be located. * Compensation for pipeline right-of-way for those sections of the pipeline which run through property owned by the City/Port of Richmond. The pipeline project will also generate utility tax revenue for the City of Richmond, as well as materially increase the City's property tax base. The proposed pipeline system will offer customers an alternative to the water transportation of crude oil in the Richmond to Martinez shipping corridor. It will provide users flexibility in the areas of cargo handling and transportation cost control, while at the same time achieving the environmentally favorable results of reducing both tanker traffic and vessel to vessel lightering of crude oil in the greater San Francisco Bay Area. 5/20/96 N W CIS ic `70 RIM, q X�. Thank you for the opportunity to comment on this document. The ongoing LTMS process has been and is a great effort which we hope will allow us to move beyond the problems plaguing dredging and disposal projects in the Bay Area. However, we are concerned that the policy/programmatic DEIS/EIR may go too far in specifying policy detail and guidelines which may have the impact of limiting options for dredging projects in the future. As a programmatic document, the DEIS/EIR should outline the many options and opportunities available, as well as delineating problem areas. But additional scientific basis is necessary prior to specification of the kind of policy decisions contained in this document, particularly as these policies relate to upland disposal, sediment testing protocols, and disposal limits. Much work needs to be done in these areas before specific policies can be considered. Most importantly, many of the specifics with which the programmatic DEIS/EIR attempts to deal, are more appropriate to the specific review required by NEPA and CEQA at the project level of detail. And lastly, we are concerned that selection of a preferred alternative with percentage disposal limitations may curtail the range of options available, resulting in the same sort of disposal problems experienced in the recent past. For example, upland disposal sites are not specified in the DEIS/EIR, yet the document attempts to detail site management and monitoring plans. These details should be included in the site- specific level of environmental review. Contra Costa County has historically supported upland disposal and the beneficial reuse of dredged materials in general. But, the County does not wish to see this disposal method mandated when other alternatives may be more appropriate, when cost-sharing provisions are not yet in place, or when this disposal method is not cost-effective for other reasons. As a result, it would be premature to determine maximum disposal limits. We understand that the LTMS advocates upland disposal/reuse, yet no mechanisms exist at the federal level to facilitate funding or selection of this option, and economically many questions remain to be resolved. It is important at this juncture to maintain flexibility in terms of disposal options if we are to facilitate dredging and disposal in a timely manner. Therefore, if a preferred alternative is required, the County would suggest a preferred alternative which discounts no disposal options and has no disposal limits at this time. Testing protocols need to more accurately reflect complex local environmental conditions in order to adequately consider changes to that environment. The County understands that many sediment tests taken at considerable expense have been less than effective at determination of the effects of a dredging project. Test protocols need to be revamped to reflect a dynamic and changing Bay-delta ecosystem. Contra Costa County appreciates your attention to our concerns, with the hope that the LTMS agencies will embark upon further study to obtain the necessary detail and scientific basis to enable sound policies which allow dredging in a timely, economic and environmentally safe manner. Use of the DEIS/EIR as a guidance tool, coupled with the specifics contained in the project level environmental reviews will provide the complete prescription for sound dredging and disposal practices.
