SUBJECT: PROPOSED RESPONSES TO REPORT NO. 9610 OF THE 1995-1996 GRAND
JURY
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
DETERMINE the response to the report of the 1995-1996 Grand Jury:
No. 9610, "Political Activities in Contra Costa County Buildings."
BACKGROUND:
The 1995-1996 Grand Jury filed the above report which was reviewed by the Board of
Supervisors and subsequently referred to the Internal Operations Committee. On August
5, 1996 and September 16, 1996 our Committee met to discuss the recommendations and
review proposed responses.
The Internal Operations Committee concurred on the response to Recommendation
Number One. The Committee, however, could not agree on the report to the response to
the second recommendation and is providing two alternatives for your consideration.
Alternative I is the proposed response from Supervisor Bishop; Alternative II is the
proposed response from Supervisor Rogers; or the Board may determine a third response.
Your adopted response will be provided to the Presiding Judge of the Superior Court.

"POLITICAL ACTIVITIES IN CONTRA COSTA COUNTY BUILDINGS"
Report No. 9610
The 1995-96 Contra Costa County Grand Jury recommends that the
Board of Supervisors :
RECOMMENDATION NO. 1 :
Adopt a policy in conformance with the California Government Code,
Section 3207 regulating the political activities of all County
employees during work hours . The policy is also to address the use
of County property, equipment and facilities for political
activities :
RESPONSE:
A. This recommendation is adopted as modified.
B. Administrative Bulletin No. 405, Subject: "Political
Activities, " will be amended by the County Administrator to
include the following language, subject to meeting and
conferring with employee representatives under the Myers-
Milias-Brown Act:
"Pursuant to Government Code Section 3207 ,
except as may be required by constitutional
rights to freedom of speech, no funds,
employee or other services, supplies,
equipment, or other personal or real property
of Contra Costa County or of any other agency
governed by the Contra Costa County Board of
Supervisors shall be used for the purpose of
supporting the election or defeat of any
elected public officer or candidate for public
office. "
RECOMMENDATION NO. 2 :
Require that a copy be signed by every employee and retained in
their official personnel file.
ALTERNATIVE I . RESPONSE RECOMMENDED BY SUPERVISOR BISHOP:
A. This recommendation is adopted in part.
B. The Board directs that the Administrative Bulletin be
incorporated into an employee information pamphlet with
various other employee issues which is received by new
employees upon employment, and that employees sign a statement
that they have read the pamphlet. This issue will be a
continuing referral to the Internal Operations Committee until
such time as an alternative form which the written
acknowledgement of the policy will take is determined.
ALTERNATIVE II. RESPONSE RECOMMENDED BY SUPERVISOR ROGERS:
A. This recommendation is not adopted at this time. However,
this recommendation needs to be studied as part of a larger
review.
B. The Board directs the County Administrator and Human Resources
Director to report to the Internal Operations Committee on the
current process for informing employees of County policies,
whether the present practices are appropriate, any recommended
changes and costs related thereto.
