MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: September 17, 1996 SUBJECT: Approve and Authorize the Chair to Execute Program Supplement No. 108 for the Replacement of Barrier Rail at Marsh Creek Bridge No. 28C-398 in the Clayton Area. Project No.: 0662-6R4248-95 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute Program Supplement No. 108 which provides$33,340 in Highway Bridge Replacement and Rehabilitation funds for the replacement of barrier rail at Marsh Creek Bridge No. 28C-398. II. Financial Impact: There is no impact to the general fund. The supplement provides reimbursement for 73.3% ($33,340) of the County's costs for this project. Road funds will provide the remaining 16.7% of the County's costs for this project. III. Reasons for Recommendations and Background: On June 21, 1977 the Board approved the County/State Master Agreement No. 04-5928 for the funding between the County and the California Department of Transportation (Caltrans). The agreement entitles the County to receive the Federal funds for roads projects that were accepted in the Highway Bridge Replacement and Rehabilitation Program. IV. Conseguences of Negative Action: If this program supplement is not approved the Coun y will lose this funding. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals - or as required for efficient operation of the completed improvements . 2 . The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /Detail Estimate or its modification (PR-2A) or the FNM-76, and accepts any increases in Exchange Funds, State Matching funds, and\or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 3 . In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 4 . Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub-contractor incurring over $25, 000 on the project . The audit report must state the applicable cost principles utili . zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22 , Allowable Costs. Page 2 of 2
