The matter of the second amendment to the lease with Buchanan Field
Airport, Concord area was deleted from the board agenda to be
relisted on September 24, 1996, and the Board gave direction to the
Public Works Director to provide a summary of the facts in this
matter for Board consideration at the September 24, 1996, Board
meeting.

SUBJECT: BUCHANAN FIELD AIRPORT - BUCHANAN EAST HANGAR COMPANY - SECOND
AMENDMENT TO LEASE
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE and AUTHORIZE the Public Works Director to EXECUTE, on behalf of the County, a
Second Amendment To Lease with Buchanan East Hangar Company, under the terms and conditions
more particularly set forth in said Second Amendment To Lease.
Il. Financial Impact:
The tenant will perform approximately $15,000 of maintenance improvements at the Buchanan Field
Airport.
III. Reasons for Recommendations and Background:
The Buchanan East Hangar Company (tenant) currently leases approximately .40 acres of land at the
Buchanan Field Airport. The tenant has expressed its desire to extend its lease by an additional ten
years. The tenant has agreed to complete maintenance improvements at the Airport as consideration
for the lease extension.
IV. Consequences of Negative Action:
The lease with Buchanan East Hangar Company will not be extended, and maintenance improvements
at the Airport will not be completed by the tenant.

SUBJECT: REQUEST FOR CONTINUANCE OF CONSENT ITEM C.14 SCHEDULED FOR THIS
SEPTEMBER 17, 1996 MEETING AND OBJECTION TO ACTION ON PROPOSED
ORDINANCE FROM SHORT DISCUSSION ITEM SD.3 FROM THE SEPTEMBER
10, 1996 MEETING.
I, Anthony R. Tiritilli a sub-lease holder of LCA Inc. at the Concord Airport request the subject
Consent Item on the Board's agenda be continued for a period of sixty days to ensure due process for
the following reasons:
1. The continuation of this matter will not materially effect the County nor the leasee. This
extension is believed to be significantly in advance of the expiration date of the current lease.
2. Knowledge of the County's activities in extending this East Ramp lease and a lease
extension recently approved by this Board for a lease extension on the West Ramp were
unknown to myself and seem to be unknown to other interested parties (sub lease holders)
and appear to have elements of covert and concealment.
3. Information and potential evidence has been discovered indicating these lease extensions
submitted as separate transactions by the Manager of Airports and are, in fact, a single
transaction. This includes the barter of grading work promised by Mr. Alves of LCA Inc.,
with a reported value of$15K, in trade for approval by the Manager of Airports of the West
Ramp lease extensions and the lease extensions for four units on the East Ramp. Supervisor
DeSaulnier's office reported 8/28/96 a significant amount of grading work was to be
performed for the approval of the West Ramp extension as well as the East Ramp extension.
Two days later Supervisor Bishop's office informed another sub leasor the airport
management informed them there was no connection between the two extensions. Also
Mr. Alves of LCA has personally informed several of the sub leasors and others, he had to
commit to perform a substantial amount of grading work to acquire approval of the West
Ramp extensions as explanation of why he doubled the extension price to the sub leasors.
Time is necessary to acquire detailed information from the Manager of Airports and ascertain steps
which should be available to insure due process. In view of potential improprieties in the extension of
the subject lease extensions, it is important this item not be permitted to be approved under the
proposed Ordinance permitting County Staff blanket authority to approve leases.
