SUBJECT: PRIVATE ELECTRONIC HOME DETENTION & SHERIFF'S AGREEMENT
SPECIFIC REQUEST(S) OR RECOMMBNDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Authorize the Sheriff to enter into an agreement with
Sentencing Concepts, Inc. , a private firm, for electronic
monitoring of inmates on a limited closely scrutinized basis
in an amount not to exceed $25, 000 .00.
FINANCIAL IMPACT•
Cost of running the program will be paid through the Custody
Alternative Bureau program fees.
REASONS FOR RECOMMENDATION:
Certain inmates referred to the Sheriff for out-of-county
programs cannot be accommodated due to various administrative
reasons.
To allow those qualified for an out-of-custody program to have
the opportunity to remain or become a productive member of
society, it is necessary to have alternatives to incarceration
available to the Sheriff. One such alternative is an
agreement with a private electronic -home monitoring firm
1203 .016 of the Penal Code authorizes the Sheriff, with the
Board of Spervisors' approval, to enter into an electronic
home monitoring contract with a private company.
BACKGROUND:
January 1, 1995, AB152 became law. Under AB152, no private
electronic home monitoring firm may operate in the County
without a signed agreement with the Correctional Administrator
and approved by the Board of Supervisors.

PRIVATE ELECTRONIC HOME DETENTION & SHERIFF'S AGREEMENT
The Sheriff must closely monitor the contract, and all inmates
allowed to apply for an out-of-custody program by the courts
must be evaluated and approved by the Sheriff prior to being
referred to a private firm.
The authority to establish the program and contract with a
private firm is granted the Board of Supervisors in Penal Code
1203 . 016 .
CONSEQUENCES OF NEGATIVE ACTION
If this proposal is not approved, the ability to allow some
qualified inmates the opportunity to become a productive
member of society will not be possible. The remaining
alternative is incarceration, an alternative that adds to the
Sheriff ' s Detention Facilities inmate population, thus
increasing housing costs .
