SUBJECT: AUTHORIZE THE CHIEF ENGINEER TO EXECUTE ALL NECESSARY APPLICATIONS
FOR REZONING, DEVELOPMENT PLAN AND TENTATIVE MAP FOR THE PINE CREEK
DETENTION BASIN SURPLUS PROPERTY, WALNUT CREEK AREA.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
Approve and Authorize the Chief Engineer to execute all necessary applications for Rezoning,Development
Plan and Tentative Map with the Contra Costa County Community Development Department for the Pine
Creek Detention Basin Surplus Property, Walnut Creek area.
II. Financial Impact:
There will be no impact to the General Fund. The submittal fee for all necessary applications for Rezoning,
Development Plan, and Tentative Map will be approximately $30,000 which will be funded from Flood
Control District's Zone 3B.
III. Reasons for Recommendations and Background:
The Pine Creek Detention Basin Surplus Property project area, totaling approximately 37 acres, is located
east of Pine Creek Road and west of North Gate Road in Walnut Creek. The Flood Control District is
proposing to rezone the existing land use from A-2 General Agricultural to P-1,Planned Development. This
rezoning will allow the District to prepare a conceptual plan for the overall development of the site that is
consistent with the City of Walnut Creek and Contra Costa County's North Gate Specific Plan. The property
is currently owned by the Flood Control District and is now considered to be surplus property.
Revenues raised from the sale of the Pine Creek Surplus Property will be used to repay more than
$2,000,000 in unpaid claims currently owed the District from the State of California Flood Control
Subvention Program. These revenues will then be used to construct needed regional drainage improvements
within our County.

IV. Consequences of Negative Action:
Failure to support the District's request to approve the development applications for the existing Pine Creek
Detention Basin Surplus Property would prohibit the District from obtaining the best market potential for
this property and could possibly jeopardize future regional drainage improvement projects in our County.

Board Agenda
Several weeks ago an agenda item recommending that the Chief Engineer be authorized
to sign County applications for the processing of a development plan for the Pine Creek
Detention Basin surplus property was pulled to give Mr. Mitch Jenkins the opportunity to
speak to the Board on the proposal. Since then we have met with Mr. Eric Hasseltine,
representing Mr. Jenkins, to explain the extent of the work to be performed under the
proposal. Mr. Hasseltine has informed us that they no longer are interested in addressing
the Board on this issue. Consequently, we have requested that the County Administrator's
Office move this item on the September 10, 1996 agenda from "short discussion" to
"consent."

SUBJECT: Pine Creek Surplus Property
In response to your questions concerning the status of the Flood Control District's Pine Creek
Detention Basin surplus property we have prepared the following report.
As you know, the surplus property is approximately 37 acres in area and is located immediately
adjacent to the Pine Creek Detention Basin. The property was originally purchased to provide the
District a place to dispose of the 700,000 cubic yards of excavated material that would be generated
in the construction of the Pine Creek Detention Basin. The material was placed and compacted on
the surplus property during the construction of the basin which reduced the overall cost of the project
by an estimated two to three million dollars. By utilizing the surplus property as a local disposal site,
the District was able to also mitigate the traffic impact that would have resulted from having to haul
the surplus material elsewhere.
Since the completion of the project, the District has secured domestic water to the site through
Contra Costa Water District and has worked in conjunction with the City of Walnut Creek and the
County's Community Development Department in completing the North Gate Specific Plan. The
North Gate plan includes specific details of how this property is to be developed,
On March 16, 1993) the District went to the Board of Supervisors with a report from the Chief
Engineer regarding the ultimate disposal of the Pine Creek Detention Basin Surplus Property and
requested that the item be referred to the Finance Committee for review and recommendations. The
Finance Committee brought back their recommendations to the Board on April 27, 1993. The
Committee recommended that the Board defer consideration of the disposal of Pine Crack Surplus
Property for at least 12 months and to relist the item for the Finance Committee Agenda for April
1994. In addition, the Committee recommended to direct the Director of the Growth Management
and Economic Development Agency (GMEDA) to discuss potential plans for the property with
officials from the City of Walnut Creek and for GMEDA to process a tentative map for the property.
To my knowledge this item never went back to the Finance Committee in April 1994.
In March 1995,District staff began the planning process for the ultimate development of the surplus
property. A site development team was established consisting of representatives from the City of

Walnut Creek, the County's Public Works and Community Development Departments, and Flood
Control District staff. The team reviewed the site and prepared the conceptual plan for the overall
development of the property that would be consistent with the North Gate Specific Plan. During the
course of this planning process, District staff along with the Director of GMEDA held several
meetings with individuals and groups who expressed interest in the development of the property.
In January 1996,the team believed that their objectives had been completed and that it was now time
to obtain a consultant to complete the final engineering and to process a Vesting Tentative Map for
the surplus property.
On February 6, 1996, the Flood Control District went back to the Board of Supervisors and obtained
their approval for the Chief Engineer to execute a Consulting Services Agreement with McGill-
Martin-Self, Inc. for preparation of the tentative reap. During the course of the development of-the
Vesting Tentative Map, the Chair of the Board, Supervisor Jeff Smith, received a letter from Mitch
Jenkins offering to sell the District an additional five acres adjacent to the surplus property. Mr.
Jenkins felt that if the District could buy his property and incorporate it into our development plans
that we would end up with a superior map that would enable us to increase our estimated profits from
the sale of the property. At the request of the Chair of the Board, District staff along with our
consultant looked into the feasibility of purchasing Mr. Jenkins property. Consequently to Mr,
Jenkins request, staff has found that from a planning, econonmic and engineering prospective, there
was no clear advantage in combining the 5-acre Jenkins parcel into the District's project. In fact, due
to specific constraints within the North Gate Specific Plan it would be difficult for the District to
maximize the full potential of Mr.Jenkins property. Therefore, we decided to decline his offer. Mr.
Jenkins was one of the individuals that had expressed 'interest in the surplus property and had several
earlier meetings with District staff-

taffThe District is now planning to appear back before the Board of Supervisors on September 10, 1996
to request that the Board approve and authorize the Chief Engineer to execute all necessary
applications with the County's Community Development Department which will allow the District
to complete our Vesting Tentative Map for the surplus property. The District plans to auction off
our parcel with an approved Vesting Tentative Map later this fall in accordance with Government
Code Section 25363.
The District appreciates your concern in this matter and is willing to discuss or answer any additional
questions you may have in regards to the development of the surplus property.
