SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deeds dated August 14, 1.996, from
Beverly G. Hammons.
B. AUTHORIZE the Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for$10,000 payable to Chicago Title Company, 590 Ygnacio Valley Road,
Suite 300, Walnut Creek, CA 94596, Escrow Number 76067, to be forwarded to the Real
Property division for delivery.

D. DIRECT the Real Property Division to have the above-referenced Grant Deeds recorded
in the Office of the County Recorder.
11. Financial Impact:
Payment of$10,000 from Drainage Area 56 funds.
III. Reasons for Recommendations and Background:
These property rights are required for the East Antioch Creek project, part of the East Antioch
Creek Watershed Area Drainage Improvement Plan. The marsh between Wilbur Avenue and
Cavallo Road will be cleaned up and opened to increased tidal water flow preserving and
enhancing the riparian habitat. Over time, the project will result in the reversion of the existing
freshwater marsh to a more natural saline marsh.
IV. Consequences of Negative Action:
The District will be unable to protect and preserve this valuable environmentally sensitive habitat.

more particularly described as follows:
Beginning at the southeast corner of said Lot 18; thence from the Point of Beginning, north 89°29'35"
west 183.00 feet, to a point on the south line of said Lot 14, said point from which a radial line of a non-
tangent curve concave to the northeast, having a radius of 200.00 feet, bears north 18°38'58" east;
thence northwesterly along the arc of said curve, through a central angle of 34038'30", a distance of
