BRAGDON - County DIRECTOR OF COMMUNITY DEVELOPMENT DATE: August 6, 1996 SUBJECT: Oil, Chemical and Atomic Workers' (OCAW) Health and Safety Representative Agreement with Shell Oil Company (Land Use Permit #2009-92) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Accept report from the Director of Community Development regarding the status of Shell Oil Company's Agreement with Oil, Chemical and Atomic Workers union to appoint a Health and Safety Representative. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS On June 25, 1996 the Board's ad hoc committee recommended that the Board find Shell in compliance with Land Use Permit No. 2009-92 (Conditions 2C, 22, 23 , 80 and 81) . The Board accepted this recommendation and requested that staff return to the Board in the near future to report Shell's progress in appointing an OCAW Health and Safety Representative and to explain further the nature of this position. (via CDD) Jeff Dodge, OCAW (via CDD) J:\jbigg\she11ds.bo August 6, 1996 ,Page Two On July 3, 1996, Shell submitted a tentative agreement with OCAW concerning the Health and Safety Representative. The Agreement was approved by OCAW's Union Adjustment Committee in early July and was ratified by the OCAW membership on July 23, 1996; it will be signed as soon as possible by OCAW's International Representative. OCAW expects this Health and Safety Represen- tative to be appointed in early August and to attend OCAW's National Health and Safety Representative Training Program in mid- August. Staff has reviewed the Agreement and discussed the position with both Shell and OCAW. The Health and Safety Representative is appointed jointly by Shell and the OCAW and has an opportunity to become involved in practically every aspect of Shell 's safety and incident response programs. The Health and Safety Representative participates in Shell's Audit program, may meet directly with regulatory officials when they visit the refinery, and becomes involved in the refinery's policy-making. Union members may communicate directly with this Representative, ensuring that their safety concerns are not easily dismissed. In addition, the Health and Safety Representative provides a communication link between management and the Union' s bargaining unit. The Health and Safety Representative Program is approximately two years old nationwide; other Bay Area refineries (Unocal, Tosco and Chevron) have OCAW Health and Safety Representatives. The program is too young for us to measure long-term benefits, but OCAW believes the experiences have been generally positive in these three other Bay Area refineries. J:\jbigg\she11ds.bo
