Recommended Action: A. APPROVE the following conceptual process improvements for permit streamlining as outlined in Section V. B. DIRECT staff to return with detailed action items to implement the proposed process improvements for permit streamlining. H. Financial Impact: There will be initial costs associated with staff time needed to implement the permit streamlining improvements. Many of these improvements, however, are aimed at creating a long term savings through improved process efficiencies. III. Reasons for Recommendations and Background: Permit Streamlining Workshop: On June 4, 1996, the Board held a workshop on permit streamlining. At the workshop staff reviewed the current permit process along with a conceptual layout of a streamlined process. Staff had also analyzed the zoning ordinance, in the context of streamlining the review of projects, to determine which review steps are required by State statute and which are the result of local ordinance. Reasons for Recommendations and Background: Continued At the workshop the Board requested staff to: 1) return with proposed improvements for permit streamlining; 2) check the notification list for accuracy; 3) renotify all those interested in the permit streamlining efforts and inform them that the next meeting before the Board will be on August 6, 1996, and;4)to meet with the Home Builders Association before the August 6, 1996, Board meeting. As a result, the staff has done the following: a. Reviewed, revised and expanded the mailing list. The revised mailing list is attached as Attachment 1. b. Mailed letters and an activity summary to each of the organizations and individuals on the revised list. The letter that was sent out is attached as Attachment 2. The responses to our mailing are attached as Attachment 3. C. Met with the Home Builders Association. Process Improvements: Staff has developed a conceptual outline of proposed changes to accomplish permit streamlining. The proposed improvements fall into four different categories: 1. Application Acceptance Process: To achieve,the highest quality of submittal materials and to allow as many decisions as possible at the time of application submittal. 2. Ordinance Changes: To revise the ordinance code to achieve the intended overview and project outcome without undo expense or delay. 3. Application Tracking, Cost Accounting and Billing: To improve accounting automation and project tracking. 4. Staff Reports and Conditions of Approval: To improve the format of staff reports and conditions of approval and distribute them to applicants and interested parties for review prior to the hearing. Consultant Report: At the June 4, 1996, Board Workshop, staff also included a Development Process Streamlining Report that was prepared by Pacific Mutual Consultants. The report compared the Contra Costa County process to State Regulations and to current procedures in Tracy, Livermore and Sutter County. The report methodology allows comparison of the Contra Costa County process with any other jurisdiction in California for the various types of projects that are processed, such as zoning changes, specific plans, subdivisions, use permits, variances, building permits and CEQA review. The report listed 29 recommended system modifications. These recommended modifications have been reviewed and are divided into three categories of implementation timing: 1) currently underway, 2) begin implementation in six months, and 3) long term implementation project. These categorized recommendations are attached as Attachment 4. IV. Consequences of Negative Action: There will be no follow up with the workshop on permit streamlining. Outline of Permit Streamlining Process Improvements: Process Streamlining: The current process has evolved over time and has been altered by new State and Local requirements. Upon examination, it becomes clear that the review and compliance function is intertwined with the evaluation and participation demanded by community groups. All parties involved in the process may become confused over the conditions, review authority, procedure, and role. The new proposed process will separate the compliance function performed by staff(that which is required by state law) from the community compatibility concerns (that which is desired in a community context). Under this proposal, our efforts will be to make the compliance aspects as short and clear as possible, leaving whatever time is desired for the compatibility issues. This will allow staff to maintain a better level of accountability by removing them from being responsible for delays requested by special interest groups. In separating the compliance function from the compatibility function, processing time and costs associated with development applications can be more easily predicted. Information Technology: Staff reports, conditions of approval, application tracking, timekeeping, bond accountability and billing are all candidates for an integrated information system. The information technology currently in use includes components which are antiquated, limited in flexibility and adaptability and do not provide the interaction opportunities necessary for effective coordination of the three departments in GMEDA. Staff is working on both the functional and technical requirements of a new system which will enable every aspect of a project to be processed and monitored throughout the life of the project. Proposed improvements to the permit process: The following improvements are proposed to accomplish permit streamlining: 1. Application acceptance process: To achieve the highest quality of submittal materials and to allow as many decisions as possible when the application is accepted. • Develop matrix of standard requirements for simple, straight forward projects • Improve information access at the Application and Permit Center to enable preparation of preliminary Conditions of Approval. • Determine what information/maps are needed at the Application and Permit Center to enable preliminary Conditions of Approval to be prepared (e.g., like N. Richmond P-1 maps) • Develop design standards and guidelines to clarify code requirements(e.g., creekside development) • Install computers at the Application and Permit Center front counter • Develop threshold criteria of when certain requirements are needed (e.g., right of way, sound wall, frontage improvements, etc.) • Require photos of the site be submitted with the application • Develop a list of required information to be submitted with development permit applications. • Develop a handout to advise applicants of the time limits the County must adhere to when processing development applications. 2. Ordinance Code changes: To revise the ordinance code to achieve the intended overview and project outcome without undo expense or delay. • Small lot design-eliminate review process (current process can require six months). • Off-street parking - Modify to allow for compact car dimensions and enhanced landscape standards (may reduce process time of commercial, industrial, multiple family projects by three months). • Child care - Modify the administration of the Ordinance to see that concerns are addressed early in the review of a project. • Water conservation landscaping -No change recommended. • Transportation Demand Management-Recommend the ordinance be partly repealed due to change in State statute. Substantial streamlining benefits will not result from repeal of this ordinance. • Home Occupation - Modify this provision in the code to allow for administrative review only where specified criteria are met. • Commercial Radio and Television Transmitting Facilities - Modify ordinance requirements where certain characteristics are present (size, shape, height, etc.). Retain development permit requirements for other transmitting and receiving facilities to avoid negative siting effects. • Forestry-Recreation District (F-R), Water Recreation District (F-1), Light Agricul- tural District (A-1) - Rezone existing properties to districts that conform with the general plan. • General Agriculture District (A-2), Heavy Agriculture District (A-3), Limited Office District(0-1), Administrative Office District (A-0), Community Business District (C- B), Controlled Manufacturing District(C-M), Light Industrial District (L-1) -Zoning district provisions should be modified and clarified to meet need of contemporary land use. • Zoning of Airport Properties -Devise and apply appropriate airport zoning districts for both county airports, so that they can serve subregional economic development in the future. Eliminate existing unrestricted (U) zoning from the code (now applied to Buchanan Field Airport). • Planned Unit District (P-1) -Expand the use of this district. • Agricultural Zoning Districts - Modify agricultural districts to allow for more agriculturally related uses as permitted uses. • Commercial Business Zoning Districts -Modify the structure of commercial zoning districts(R-B Retail Business District, N-B Neighborhood Business District, P-N-B Planned Neighborhood Business District, C General Commercial District, and C-B Community Business District)to better reflect the range of types and complexities of involved projects. Consider combined and simplified review of development plan and land use permit application reviews for less complex projects. • Light Industrial District (L-I) - Modify the provisions of the L-I Light Industrial District to provide clarity on land use permit requirements, and to allow consideration of identification sign meeting criteria without issuance of a land use permit. • Take-out Food Establishment Ordinance-Modify ordinance to eliminate requirement for bonding for litter pick-up. 3. Application tracking, cost accounting and billing: To improve accounting automation and project tracking • Coordinate project tracking with Community Development Department, Public Works Department, and the Application and Permit Center • Prioritize work list from Community Development Department to Public Works Department(what project Community Development Department wants Public Works Department to work on) • Develop noticing to applicant before expenditures reach 100% of fees • Implement joint Community Development Department/Public Works Department database for accurate billings and timekeeping 4. Staff reports and conditions of approval: To improve the readability and clarity of staff reports and conditions of approval and to improve distribution to interested parties • Clarify and simplify standard conditions of approval • Group conditions in relation to project milestones • Identify project issues in staff report • Require applicant to indicate status of completion of each conditions of approval at each project milestone • Add sign off space and date line to each condition of approval • Identify timing and sign off for fire district requests (e.g., hydrants) • Distribute conditions of approval to interested parties prior to hearing x . 13 . � 4 SUBJECT: Approval of Proposed Improvements to the Permit Process DATE: August 6, 1996 Page -5- Schedule of review and Presentation of Permit Streamlining before the Board: 1. Our ultimate goal was to identify way to produce a more efficient method for processing development permits. Our consultant wrote a report which compares the Contra Costa County process to State regulations and to procedures in Tracy, Livermore and in Sutter County. The methodology allows comparison to Contra Costa County process with any other jurisdiction in California for zone change, specific plan, subdivision, use permit, variance, building permit, and CEQA review. The report lists twenty-nine recommended system modifications . These recommendations include: reduce length and complexity of staff reports, computerize project logs, provide sample conditions of approval, use a development review process in place of the preapplication review process, minimize physical separation among departments, adapt regulations clarifying the roles of advisory committees, fast track high priority items, and establish a computer linkage between the Permit Center and on-site inspectors . The report identifies privatization options and steps to incorporate privatization. It describes the primary benefit as speedy, economically focused work, however it is limited by reduced public accessibility and accountability. The report includes sample documents from other jurisdictions such as process schedules and standard conditions of approval. Process Streamlining The current development process has evolved overtime with periodic alterations by new State and local requirements . Upon examination, it becomes clear that the review and compliance functions performed by staff have become intertwined with the evaluation and participation demanded by community groups . As a result, all parties become confused over conditions, review authority, procedure and role. A new approval process will be proposed which will separate the "compliance" function performed by staff from the community "compatibility" concerns . Working within this concept, our efforts eDAz permWream.sum 7/10196 will be to make the compliance aspects as defined, short and clear as possible; setting whatever time is desired for compatibility issues . This will allow us to maintain a higher level of accountability for staff time associated with a project. It will remove staff from responsibility for delays caused by special interests . In separating compliance functions from compatibility functions the processing and costs associated with development applications will be more easily predicted and allocated. It is our intention, in the near future, to directly bill the applicant for all work associated with the project. This will allow staff time and other costs associated with the application to be more easily tracked. A distinction will be made between the legal requirements of processing and that work related to community compatibility. Information Technology The information technology currently in use includes components which are antiquated, limited in flexibility and adaptability, and do not provide the interaction opportunities necessary for effective coordination of three departments . The core data storage and retrevial component for the Growth Management and Economic Development Agency is a centralized base of information and processing which assists GMEDA personnel in managing the land development process in Building Inspection, Community Development and Public Works . The system is also used by the Assessor, Tax Collector, Environmental Health, Recorder and related offices . Staff reports, conditions of approval, application tracking, time keeping, bond accountability and billing are all candidates for an integrated information system. Staff is working on both functional and technical requirements of the new system to enable every aspect of a project to be processed and monitored through the system. For example, use of bonds and other means to ensure development compliance becomes an important topic every time it is discovered that a developer cut corners on required improvements, or that bonds haven't been released when they should have been. Bonds and/or agreements are used by Public Works, Building Inspection, Community Development, and Health Services . Activities, timing and release circumstances can be tracked to ensure accuracy in activities associated with bonding. Eon: permitstream.sum 7/10196 P• . Ordinance Options Reduction of processing time is most greatly affected by whether a project is determined to be ministerial or discretionary. For a ministerial approval, once conditions are reviewed and met, the permit is granted administratively. A discretionary permit requires judgement in addition to satisfying conditions . It also may trigger CEQA evaluation (though many discretionary permits are exempt) . Discretionary review procedures have expanded in time and complexity due to formation of municipal advisory councils and other forms of community input. The following items are recommend- ed for streamlining review and possible reduction in procedural steps . Small Lot Review - current process can require six months . Off-Street Parking - current process can require four months . Child Care Facilities - current process can require several months . Water Conservation - current process requires two to three weeks . TDM - suggest repeal due to change in State statute. Cabarets - current processing requires four to six months . Home Occupation - current processing requires four to six months . Commercial Radio and Television Transmitting Facilities - current processing may take six months . Development Plans - current procedures can take six months . Because you ask for the response prior to 26 July, it is not possible to have public discussion at our regular meeting (which is scheduled for the final Tuesday of each month,thus 30 July this month). Also, the information that you have provided with your request letter does not spell out the specific recommendations, but rather (in the document labeled "Contra Costa County Permit Streamlining Project: July 1996")provides a fragmented overview that omits specific actions. Speaking to this overview is not of much value because of its vagary. From other sources I have received copies of two documents that do indeed provide informa- tion about what your office is proposing to the Supervisors. These documents are: (1) the Pacific Municipal Consultants' report(herein referred to as PMCR) and (2) an unattri- buted, unsigned, and undated document labeled "Zdning and Development Streamlining Issues(I'll refer to it as ZADSI)." If one takes the view that your offices have public service as their basic purpose, then it is very hard to see why the documents in question or at least the specific recom- mendations in them were not mailed to the MACS for their review. Reading through both the PMCR and ZADSI,it is, indeed, hard to discern any concern for public interest; the entire focus is on speedily providing permits to developers. By the same token, your demand for opinions to be returned within specified brief times provides for little or no public consideration or discussion. The following responds to the specifics in PMCR and ZADSI reports described above. (1) The consultant's report PMCR (page 32) recommends that MACs be given infor- mation to clarify their "precise duties and powers." We at KMAC agree whole- heartedly, and take this opportunity to add that the MACs also be given written -1- �. 13 documentation that clarifies the "precise duties and obligations of the County Planning Department with respect to the MACs" Over its six years in operation, the members serving on KMAC have undergone very considerable frustration in attempting to have an orderly interchange with the planning department. On page 33, PMCR recommends that MACS act "within 30 days following the application submittal." This time line is unreasonable-- volunteer citizen groups should not be forced to convene meetings at more than a monthly schedule. Allowing for time to prepare and to post Brown-act-mandated agendas, it is clear that the maximum time delay should be 45, and not 30 days. We consider it very reasonable to impose a maximum delay of 45 days on a project in order to pro- vide a review of its impact. This means that the County must have its act together in order to send the information in time to notify near neighbors of any proposed project. We do NOT agree with the PMRC(also page 33) that MACs should limit their recommendations to aspects of the established regulations. In fact, the MACs represent the best opportunity for community input on the broad scale. Because the citizens in a community live with the results of a project for the rest of their days,it is certainly reasonable to allow for them to provide input that may not be embodied into some statute or regulation, but that may have relevance to a pro- ject. (2) The ZADSI report flat out recommends (page 3) that the small lot review be eliminated. KMAC very strongly opposes this recommendation. Of course, eliminating the small lot review would "streamline the permit process"just as kil- ling the baby would save the milk money. On KMAC, we have had several instances in which small lot reviews have produced important changes in the pro- jects. We are confident that older communities like Kensington with many non- conforming small lots are given needed protection by the small lot review. The small lot review was established precisely because the dense placement of houses in places like Kensington can produce effects that do not find exact coverage in statutes. These effects can, and should be voiced and considered in order to improve the community. Newer areas, generally, do not have small lots and would not be affected by this change. We strongly urge that the supervisors reject this ill-considered recommendation. (3) Off-street parking is recommended for modification in the ZADSI report (page 4). We are skeptical about the arguments about the prevalence of"smaller vehi- cles" at this time as contrasted with the 1960s-- especially considering the growth in popularity of off-road vehicles and trucks. Kensington has a strong need for the provision of adequate off-street parking and feels that any changes in the law should be taken only after very thorough review. We in KMAC object to the haste with which we are being asked to respond to these changes. As presented, they appear to be responsive only to the concerns of developers, and not at all mindful of the effects of projects on the larger public. We also object to being given only a vague description of what is really being proposed. Other MACs and -2- agencies, who may respond only to the sheet accompanying your letter, will certainly not be able to make substantive judgements. Although these proposals profess to deal only with "streamlining," they have direct effect on the entire development process. They strongly affect the public and should therefore be fully discussed. We ask that the proposed changes be held back for review for at least one month so that the affected groups can discuss them at open meetings. The new approval process that will deal with "compliance" aspects will decrease the amount of time it takes for the County to process a development. The separation of the "compliance" function from "compatibility" concerns is a good concept. The implementation of the separation may be difficult. Developers and citizens have come to rely on the County, CCCSD, and other public agencies as vehicles to achieve the goals or objectives of the citizens. Removal of that vehicle grill be resisted, especially.':f there is no convenient alternative. If the customers (citizens) expect a particular service from the County and are getting that service, the customers will want that service to continue. Also, I have a request regarding the changes you are considering to the areas you have designated as "Information Technology" and "Ordinance Options." I ask that you consider providing a means for CCCSD access to your integrated information system. I believe the public could benefit from the creation of a computerized interface between our two agencies.
