The Board of Supervisors of the County of Contra Costa, State of California, is requested to order the consolidation of the elections in the City of Brentwood to be held on November 5, 1996, with any other election to be held on the same regular election date, under sections 10400 through 10418 of the Elections Code. The Consolidated election shall be held and conducted, election officers appointed, voting precincts designated, candidates nominated, ballots printed, polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates of election issued, and all other proceedings incidental to and connected with the election shall be regulated and done by the County Clerk in accordance with the provisions of law regulating the regularly scheduled election. The precincts used at the consolidated election shall be those used for the statewide or regularly scheduled election and, where necessary, the county elections official may adjust precinct lines to coincide with the boundaries of the particular jurisdiction. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAMON CALLING A SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING AN ISSUE TO THE VOTERS AND REQUESTING CONSOLIDATION WITH THE NOVEMBER 5, 1996 STATEWIDE ELECTION WHEREAS, each year since 1985 the City Council has complied with the provisions of the Landscaping and Lighting Act in levying a City-wide assessment against each parcel with the funds from such assessments utilized to maintain City landscaped roadway medians, roadside areas, and street lighting; and WHEREAS, the City Council desires to conform to the requirements of the Right to Vote on Taxes Initiative with respect to obtaining voter approval for the continued levy of the City-wide Landscaping and Lighting assessment; and WHEREAS, in calling this special municipal election it is the express intent of the City Council to satisfy the provision in Section 5(d) of the initiative which exempts from the procedures and approval process of Section 4 of the initiative "any assessment which previously received majority voter approval from the voters voting in an election on the issue of the assessment.." NOW, THEREFORE, BE IT RESOLVED: 1. That the City Council of the City of San Ramon calls a special municipal election for November 5, 1996. 2. That, acting under authority of Elections Code Section 10201, the City Council submits to the voters at the aforementioned special municipal election the following proposition to appear on the ballot as follows: Shall the City of San Ramon continue to levy under the Landscaping and Lighting Act for maintenance of YES landscaped roadway medians, roadside areas, street lighting and other work allowed under the Act an annual City-wide assessment of$53 per single family residential parcel for fiscal year 1997-98 and $59 per such parcel for fiscal years 1998-99 and beyond and NO for other land uses those amounts computed in accord with the 1996-97 Engineer's Report? Pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Contra Costa are hereby requested to consent and agree to the consolidation of a General District Election with the Statewide General election on Tuesday, November 5, 1996, for the purpose of the election of two (2) members to the District Board of Directors. Section 2. The County Election Department is authorized and instructed to canvass the returns of the District General Election and mail a Statement of Results to the District as soon as the result of the canvass is determined. Section 3. The Board of Supervisors are requested to issue instructions to their respective County Election Department to take any and all steps necessary for the holding of the consolidated election. Section 4. The District Secretary is directed to file a certified copy of this resolution with the Board of Supervisors of the County of Contra Costa and their County Election Department. Section 5.
