MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: August 6, 1996 SUBJECT: AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CHANGE ORDERS TO CONSTRUCTION CONTRACTS Specific Request(s)or Recommendation(s)&Background&Justification I. Recommended Action: AUTHORIZE the Public Works Director to order changes or additions in the work being performed under construction contracts subject to the provisions of Public Contract Code Article 25, provided such orders.are in writing and the extra cost to the County for any change or addition to the work so ordered is within the limits specified in the Public Contract Code, Section 20395. II. Financiallmpact: There are no financial impacts, except the recommended authorization will reduce paper work and make the administration of construction contracts more efficient. III. Reasons for Recommendations and Background: A. The Public Contract Code, Section 20395, allows the Board of Supervisors to authorize the County Road Commissioner to execute changes to construction contracts when such changes do not exceed the following: 1. $5,000.00 on original contracts for $50,000.00 or less; nor 2. Ten percent for contracts over $50,000.00, but not to exceed $250,000.00. For contracts whose original cost exceeds two hundred fifty thousand dollars ($250,000.00), the extra cost for any change or addition to the work so ordered shall not exceed twenty-five thousand dollars ($25,000.00), plus 1 percent of the amount of the original contract costs in excess of two hundred fifty thousand dollars ($250,000.00). In no event shall any such change or alteration exceed one hundred thousand dollars ($100,000.00). B. Authorization is needed so that the County can continue to process construction contract change orders in a timely manner. IV. Consequences of Negative Action: Previous policy which limits approval authority to $25,000.00 would remain in effect.
