Code § 8335) SUBJECT: VACATION OF a Portion of Howe Road ) W.0. 4283 ) CP 96-50 ) Martinez Area ) The Board of Supervisors of Contra Costa County RESOLVES THAT: This summary vacation of an excess right of way of a street or highway no longer required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This vacation request is for a portion of Howe Road located in Martinez. A description and map of the portion to be vacated is attached hereto as Exhibit "A" and Exhibit "B" and incorporated herein by reference. This vacation request is for an excess right of way of a street or highway not required for street or highway purposes. (S. & H. Code Section 8334). This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be exempt from the California Environmental Quality Act under State CEQA guidelines Section 15061 (b)(3) and DIRECTS the Director of Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the RESOLUTION NO. 96/ 341 Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for filing of the Notice of Exemption. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibits "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a public highway. A3485AY-96 EXHIBIT "A" Real property in an unincorporated area of Contra Costa County, California, being a portion of the Rancho Las Juntas, described as follows: Commencing at a point on the westerly right of way line of Howe Road, said point being the northeast corner of PARCEL ONE described in the deed to Contra Costa County, recorded July 13, 1995, at Series Number 95-110804, records of said County, said point from which a radial line of a non- tangent curve, concave to the northwest, having a radius of 20.00 feet bears north 49° 27' 52" west; thence northerly along the arc of said curve, and said westerly right of way line of H9we Road, through a central angle of 39° 21' 03", a distance of 13.74 feet to the Point of Beginning; thence from the Point of Beginning, continuing along the westerly right of way line of Howe Road, north 1" 11' 05" east 169.31 feet to the southwest corner of the parcel of land described in Resolution No. 4524 of the Contra Costa County Board of Supervisors, recorded November 16, 1965, in Book 4994 of Official Records at page 666, records of said County; thence, along the southerly line of said parcel (4994 O.R. 666), south 880 48' 55" east 60.23 feet to the easterly right of way line of said Howe Road, said point being the southeast corner of last said parcel (4944 O.R. 666); thence, along said easterly right of way line of Howe Road, south 1" 11' 05" west 113.26 feet; thence, southerly along the arc of a tangent curve, concave to the east, having a radius of 270.00 feet, through a central angle of 100 48' 11", a distance of 50.91 feet; thence, leaving the easterly right of way line of Howe Road, south 86° 23' 59" west 65.24 feet to the Point of Beginning.
