PROJECT NO. 0676-6P4070 ; South County Area SPECIFIC REQUESTM OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION I. Recommended Action: DECLARE that the County's obligation under the Reimbursement Agreement (Crow Canyon Road Extension, Resolution 96/560, adopted September 16, 1986) with the Blackhawk Corporation has been satisfied. DIRECT the Public Works Director to arrange for the transfer of 10% of the remaining unobligated balance of the Crow Canyon Road Extension Fee Benefit Trust Account to the County's Southern Contra Costa (SCC) Sub-Regional Fee Trust Fund. DIRECT the Public Works Director to arrange for the transfer of 90% of the remaining unobligated balance of the Crow Canyon Road Extension Fee Benefit Trust Account to the City of San Ramon to be placed in the City's SCC Sub- Regional Fee Trust Fund. DIRECT the Public Works Director to arrange for the closure of the Crow Canyon Road Extension Fee Benefit Area Trust Account (Fund 8196). DIRECT the Public Works Director to arrange for the future collection of the Crow Canyon Road Extension portion of the Tassajara Area Transportation Improvement Fee (TATIF) to be divided as follows: 10% to the County's SCC Sub-Regional Fee Trust Fund; and 90% to the City to be placed in the City's SCC Sub-Regional Trust Fund. Reasons for Recommendation and Background: On January 28, 1986, the Board of Supervisors adopted Resolution No. 86/36 establishing the Crow Canyon Area of Benefit to collect fees from development to reimburse the Blackhawk Corporation for the construction of the Crow Canyon Road Extension. On September 16, 1986, the Board of Supervisors adopted Resolution No. 86/560 approving a County Reimbursement Agreement with the Blackhawk Corporation for the construction of the Crow Canyon Road Extension. To address the traffic needs in the region, the County, Town of Danville, and City of San Ramon entered into a"Joint Exercise of Powers Agreement (Tassajara Area Transportation Improvement Fees (TATIF))" dated April 28, 1987. Within the framework of this agreement, the County, Town, and City collected a fee from development in the TATIF area. These fees funded road improvement projects in the region, with a portion ($1,840) of each fee collected going to the reimburse the Blackhawk Corporation for construction of the Crow Canyon Road Extension. The Blackhawk Corporation has now been fully reimbursed. Recently, the County, Town and City prepared the Southern Contra Costa (SCC) Joint Exercise of Powers (JEPA). This new agreement between the jurisdictions establishes regional and sub-regional traffic mitigation fee programs, in part to fund the construction of projects necessary to mitigate the impact created by develop- ment in Dougherty Valley. The traffic study that was prepared for the Dougherty Valley Settlement Agreement between the County, Town, and City was used to identify the sub-regional road improvement projects in the SCC area. The traffic study also determined the fair share cost of the sub-regional improvements attributable to development in Dougherty Valley and attributable to development in the area around Dougherty Valley. The fair share costs attributable to development in the area around Dougherty Valley are funded through the collection of the SCC Sub-Regional Fee. The TATIF area borders the northern portion of Dougherty Valley. The SCC JEPA has been prepared with the intention of leaving the TATIF area as a separate fee area with the covenents of the Tassajara JEPA remaining in effect. The TATIF project list and the SCC Sub-Regional project list have two projects in common: Crow Canyon Road improvements and Camino Tassajara improvements. Because the TATIF area is within the SCC Sub-Regional Fee area, staff from the City, Town, and County recommend that the unobligated TATIF (Crow Canyon Road Extension) funds be used, in part, to fund those two improvement projects. Staff feels there is a sufficient conection between development in the TATIF area and the need for the improvements to Crow Canyon Road and Camino Tassajara. The existing unobligated balance of the Crow Canyon Trust Fund is approximately $180,000. There are approximately 300 remaining units in the TATIF Fee Area that have been previously conditioned to pay the TATIF. These units are expected to generate an additional $550,000 in unobligated TATIF funds. The trust fund balance is affected by interest accrued, as well as administrative charges in the form of trust fund administration and the setup charges for the Southern Contra Costa JEPA. These administrative charges are applicable only to the interest accrued, and not to fees collected from developers. IV. Consequences of Negative Action: The unobligated TATIF funds could not be used to fund construction of SCC Sub- regional projects. The SCC Sub-Regional fee would have to be increased in order to fund those projects fully.
