HomeMy WebLinkAboutMINUTES - 10181983 - T.5 T-S THE BOARD OF SUPERVISOR& OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 18, 1983 , by the following vote: AYES: Supervisors Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Appeal of L. E. Wisenberg, Jr. (applicant) from County Planning Commission decision denying Delta Coves Project, Final Development Plan 3024-82 and tentative Subdivision Map 6013, Bethel Island area. The Board on October 11, 1983, deferred to this date and time its decision on the appeal of L. E. Wisenberg, Jr. (applicant) from the County Planning Commission denial of the Development Plan 3024-82 to create 495 single family residence units, 65 townhouses, 140 berths, commercial areas and common open spaces; and tentative Subdivision map 6013; and directed the applicant to submit a letter extending the time limit provisions of (Chapter 4. 5, Government Code Section 65920 ff) to allow completion of the California Environmental Quality Act process and a decision on these applications. Harvey Bragdon, Assistant Director of Planning, advised that, as requested by the Board, the applicant had submitted a letter extending the time limit for acting on these applications; and Mr . Bragdon recommended that the Board retain jurisdiction and con- tinue the appeal to August 14, 1984, to allow for completion of the necessary EIR work. Supervisor Torlakson commented that because County Counsel could not definitely guarantee that there is no possibility that the County could lose jurisdiction in reviewing the project, he would move that the Board indicate its intent to deny the application without preju- dice and indicate it will give consideration to waiver of application fees and credit for all EIR documents that have been submitted to date. The motion was seconded by Supervisor McPeak. Mr. Jasper Sipes, representing S.O.S. , Citizens for Sensible Planning, and Alletta Belin indicated their agreement with the motion to deny. Mr. Wisenberg commented that he had done everything required of him with regard to the provisions of (Chapter 4. 5, Government Code Section 65920 ff) and objected to the motion to deny on a small technicality, and urged that the project be allowed to go forward and that the Planning Department' s recommendation for a ten- month extension be approved, stating that he would be willing to sign any documents requested by the Board. Board members discussed with staff the possible time frame of processing a new application, using the EIR information that has been submitted for the current application, and the feasibility of meeting August 1984 as a target date.
