Adopted this Order on October 18 . 1983 , by the following vote:

SUBJECT: Hearing on Rezoning Application 2553-RZ Filed
By Security Owners Corp, Pleasant Hill Area.
This being the time fixed for hearing on the
recommendation of the County Planning Commission with
respect to the application filed by Security Owners Corp
(2553-RZ) to rezone land in the Pleasant Hill area from
Single Family Residential (R-10) to Planned Unit Develop-
ment (P-1) ; and
Harvey Bragdon, Assistant Director of Planning ,
having described the property site and having advised that
the California Environmental Quality Act requirements were
adequately addressed by the Environmental Impact Report
previously prepared for Planned Unit rezoning (2390-RZ) ,
requested by the same applicant and owner; and
Mr . James D. Pretti, 15 Edie Court , Pleasant Hill ,
having appeared and expressed some concern over the amount
of traffic in the area and inquired as to what measures
will be taken regarding safety precautions ; and
Barry Whittaker, P .O . Box 430, Martinez, representing
Security Owners Corporation, having commented that he felt
the entrance to the project would be in a better and safer
condition after improvements have been made;
The Chairman having closed the public hearing and the
Board having considered the matter, IT IS BY THE BOARD ORDERED
that rezoning application (2553-RZ) is APPROVED as recommended
subject to conditions imposed by the Planning Commission, and
as set forth in Exhibit A attached hereto and by reference
made a part hereof,
IT IS FURTHER ORDERED that Ordinance Number 83-35
giving effect to the aforesaid rezoning is INTRODUCED, reading
waived and November 1, 1983, is set_ for adoption of same .

CONDITIONS OF APPROVAL OF PRELIMINARY DEVELOPMENT PLAN 2553-RZ AND FINAL
DEVELOPMENT PLAN 3019-83:
1. This approval is based on the Rezoning and Final Development Plan
applications received by the Planning Department on April 6, 1983 ,
with exhibits:
Exhibit A - Preliminary Development Plan proposed by Arthur Vance
& Associates dated April 6, 1983 .
Exhibit B - Patio home plans and sketch elevations for five (5)
different units; Plan A - 1010 sq.ft. , Plan B - 1220
sq. ft. , Plan C - 1560 sq. ft. , Plan D - 1190 sq. ft. ,
Plan E - 1330-sq. ft.
Exhibit C - Working drawings for Unit A through E prepared by Don-
ald W. Simmons, Inc. , received by the Planning Depart-
ment April 6, 1983 .
Exhibit D - Tentative Map of Subdivision #5735 prepared by Ferguson
& Wolman, received by the Planning Department June 27,
1983.
2. This approval is for a maximum of 45 dwelling units based on the
above exhibits, as modified by these conditions.
3. Accessory structures will be permitted, subject to review by the
Zoning Administrator. Several alternative patio cover designs shall
be submitted for Zoning Administrator approval. Covenants , Condit- .
ions and Restrictions shall require adherence to the approved design.
4. Fence design and location shall be subject to review by the Zoning
Administrator. Fencing along Paso Nogal shall be designed to be
sound attenuating.
5. Precise location, grading, unit .type, building material and colors
and fencing shall be subject to review and approval of the Zoning
Administrator prior to issuance of a building permit.
6. Prior to preparation of .the Final Subdivision Map, the project de-
sign shall be reviewed to comply with all applicable conditions for
approval. Grading plans shall be reviewed to retain as much topsoil
in place as possible; lot configuration location and type of unit
shall be reviewed to provide adequate patio areas for each lot, to
consider passive solar orientation as well as future active solar
access;• driveway alignments shall be revised to be perpendicular to
the street where practicable to provide ease of maneuvering in and
out of garages.
7. A six (6) foot wide pedestrian path shall be provided and shown on
the Final Map connecting South Hampton Lane to Paso Nogal at the
east side of the project.
8. Submit a revised tentative map placing the banks between fenced rear-
yards and Paso Nogal in an open space parcel to be maintained by a

a Lighting and Landscape District.
9. Covenants, Conditions and Restrictions shall be submitted prior to
recording the Final Subdivision Map.
10 . Development rights shall be deeded to the County for all Open Space
areas with the approval and filing of the Final Subdivision Map.
11. Project shall comply with recommendations of the soil and geologic
report dated 10/30/79 by Purcell, Rhodes and Associates.
12 . Prior to issuance of grading permit, final grading plans shall be
submitted to the Planning Department for review and approval.
13. Landscape and irrigation plans shall be submitted prior to recording
the Final Map or issuance of a building. permit. Low maintenance
drought resistant native plant materials shall be utilized. The open
space parcels along the Paso Nogal frontage shall be intensively
landscaped .to screen the buildings and enhance the scenic qualities
of Paso Nogal. Plans shall be submitted to the City of Pleasant
Hill for review and comment and to the County Zoning Administrator
for approval.
14 . Submit an acoustical analysis prior- to issuance of building permit
which recommends mitigation measures, if necessary, to provide in-
terior noise levels which will not exceed 45 CNEL.
15 . A statement shall be included in the deed restrictions for each lot
created to inform the public of the presence of airport noise due
to the location of the property near the flight pattern for Buchanan
Field Airport.
16. Street names shall be subject to review and approval of the Director
of Planning.
17. All utilities shall be placed underground. The project shall be
served by a cable television underground system. No individual
television antennae shall be permitted.
18. If archaeologic materials are uncovered during grading, trenching or
other on-site excavation, earthwork within 30 meters of these materials
shall be stopped until a professional archaeologist who is certified
by the Society for California Archaeology (SCA) and/or the Society of
Professional Archaeology (SOPA) has had an opportunity to evaluate
the significance of the find and suggest appropriate mitigation
measures, if they are deemed necessary.
19. Sewage disposal serving the properties concerned in this application
shall be provided by the Central Contra Costa Sanitary District. Each
individual living unit shall be served by a •separate sewer connect-
ion. The sewers located within the boundaries of the properties
concerned should become an integral part of the Central Contra Costa
Sanitary District' s sewerage collection system.
20. Water supply serving the properties concerned shall be by the Contra

Costa County Water District. Each individual living unit shall be
served by a separate water connection. Such water distribution
system, located within the boundaries of the properties concerned
in this application, should become an integral part of the Contra
Costa County Water District' s overall water distribution system.
21. Any deviations or-changes affecting the concept of the Subdivision
on file with the Department of Health Services Environmental Health
and dated April 6, 1983, shall be resubmitted for review to determine
if such deviations or changes for the Subdivision can be considered
acceptable to the Health Officer.
22 . Comply with the requirements of the Grading Section Building Inspect-
ion Department including: A grading permit is required; a soils
engineer will be required to control grading operation; pad certifi-
cation and soils engineer' s report required prior to issuance of
building permits.
23. Comply with the requirements of the Public Works Dept. , as follows:
A. Unless exceptions are specifically granted, comply with the requirements
of Division 1006 (Road Dedication and Setbacks) of the County Ordinance
Code. This includes the following:
1. Convey to the County, by Offer of Dedication, 12 feet of additional
right of way on Paso Nogal as required for the planned future
width of 84 feet.
2. Construct curb, 4-foot 6-inch sidewalk (width measured from curb
face), necessary longitudinal and transverse drainage, and pavement
widening on Paso Nogal . The face of curb shall be located 32
feet from the widened right of way line.
3. Install street lights on Paso Nogal. The final number and location
of the lights will be determined by utility company and approved
by the Traffic Engineer.
4. Relinquish abutter' s rights of access along Paso Nogal with the
exception of South Hampton Lane.
B. In accordance with Section 82-2.014 of the County Ordinance Code,
this development shall conform to the requirements of ^Division 914
(Drainage) of the Subdivision Ordinance.
C. All interior subdivision streets shall be dedicated to the County
and constructed to County public road standards. The proposed road
configuration is acceptable. Franklin and South Hampton Lane shall
be constructed as 36-foot roads within 52-foot rights of way.
D. Construct Franklin Court to a 20-foot private roadway within a 25-foot
access easement to current County private road standards.
E. Provide adequate sight distance from South Hampton Lane to Paso Nogal
in accordance with Caltrans stopping sight distances for a minimum
design speed of 40 miles per hour.

F. Prevent storm drainage, originating on the property and conveyed in
a concentrated manner, from draining across the sidewalk or on driveways.
G. Furnish proof to the Public Works Department, Land Development Division,
of the acquisition of all necessary rights of entry, permits and/or
easements for the construction of off-site, temporary or permanent,
road and drainage improvements.
H. Install all new utility distribution services underground.
I. Submit improvement plans prepared by a registered civil engineer to
the Public Works Department, Land Development Division, for review;
pay the inspection, plan review and applicable lighting fees. These
plans shall include any necessary traffic signing and striping plans
for review by the County Traffic Engineer. The improvement plans
shall be submitted to the Public Works Department, Land Development
Division, prior to the issuance of any building permit. The review
of improvement plans and payment of all fees shall be completed prior
to the clearance of any building for occupancy by the Public Works
Department. If final inspection is requested prior to construction
of improvements, the applicant shall execute a road improvement agreement
with Contra Costa County and post the bonds required by the agreement
to guarantee completion of the work.
J. Obtain an encroachment permit from the Public Works Department, Land
Development Division, for construction of driveways or other improvements
within the right of way of Paso Nogal .
K. - Provide left turn channelization on Paso Nogal at South Hampton for
the project.
L. Improve the Paso Nogal/Golf Club Road intersection as approved by
the Public Works Department. This shall include necessary signing,
striping, conform work, and drainage improvements to accommodate the
reconstruction of the existing frontage improvements . These improve-
ments shall be designed in order to eliminate the cause of past traffic
accidents.
M. Construct curb, 4-foot 6-inch sidewalk (width measured from the curb
face), necessary pavement widening, longitudinal and transverse drainage
on Paso Nogal north of the project site to conform with existing improve-
ments approximately 50 feet north of the subject property.
N. Provide an emergency access road and pedestrian trail from the internal
project circulation to MacGregor Road subject to the approval of the
Fire District.

The following are not conditions for approval, however you should be aware of them prior
to requesting building permits or recordation of the final map.
A. Comply with the requirements of the Contra Costa County Consolidated Fire
District as follows:
1. The developer shall provide an adequate and reliable water supply for
fire protection with a minimum fire flow of 1750 GPm. Required fire
flow shall be delivered from not more than two (2) •hydrants flowing
simultaneously while maintaining 20 pounds residual pressure in the
main.
2. The developer shall provide two (2) hydrants of the East• Bay type.
Locate as follows:
a. Northwest corner of South Hampton.Lane and Franklin Lane, (Lot 1) ,
b. At property line common to lots numbered 22 and 23.
Hydrants shall be installed not greater than three (3) feet from curb '
face and shall be controlled by a 6-inch street valve located not less
than five (5) feet nor greater than ten (10)- feet from hydrant barrel.
The cost of the installation to be borne by the developer.
3. Provide access roadways with all-weather driving surfaces of not less than
20 feet of unobstructed width, and not less than 13'6" of vertical clearance-,
to within 150 feet of all portions of the exterior walls of every building.
Access roads shall not exceed 20o grade, shall have a minimum inside turning
radius of 28 feet and must be capable of supporting the imposed loads of
fire apparatus (15 tons) .
4. On-street parking requirements:
a. Minimum of 27 feet width for parking on one side.
b. Minimum of 34 feet width for parking on two sides.
