C.87 LETTER, dated July 29, 1996, received from John Fulwider, Don Black, Margaret Wiley,
Hugh Afshar, and Michael Johnston, c/o 6975 Johnston Road, Pleasanton, CA 94588-
9593, property owners, Pleasanton Area, referring to an application of Wilbert Perry to
subdivide his property on Johnston Road, Pleasanton, and requesting the imposition of a
condition for a grant of easement on the west side of the creek through the Perry property.

C. 88 LETTER, dated July 26, 1996, received from the Contra Costa Council, Industrial
Association, Council of Industries, the Western State Petroleum Association, the contra
Costa Taxpayers Association, and the California Contractors Alliance, 2694 Bishop Drive,
Suite 121, San Ramon, CA 94583, expressing their support for SB 1889 (Calderon) which
would enable Contra Costa County to become a Certified United Program Agency (CUPA)
for the Risk Management Plan (RMP).

Dear Supervisors',
The Bettencourt Ranch Homeowners Association Board of Directors has reviewed Dame
Construction Company's plans for the detention basin area entitled PRIVATE PARK and dated
6/18/96. We unanimously find these plans unacceptable. We will resist this proposal 'with the
full range of legal and political options open to us. The following are the detailed reasons for our
opposition:
• The proposed Wrought Iron Fence is in no way consistent with existing Wrought Iron
Fences fronting Shadowcreek and Blackhawk. In fact, no such fence exists anywhere along
Camino Tassajara.
A similar fence does exist between Blackhawk Plaza and� the Somerset development
(photograph #1). This fence is NOT consistent with existing residential fencing in adjacent
communities and is more suitable to commercial areas such as Blackhawk Plaza.
The Wrought Iron Fence design we want is like that fronting Shadowcreek's detention basin
area as shown in photograph #2 and #3 and on page L-1 in the Planting plan dated 5/6/89 for
Bettencourt (attached). A letter dated January 19, 1988 from Michael W. Rupprecht of Dame
Construction Company to the County Community Development Department stated
"[Bettencourt's] frontage improvements ... should tie-in to the same theme and style as will
be completed in the Shadow Creek project." We agree, the Wrought Iron ,Fence should be of
the same theme and style as that of Shadow""Creek.
The Dame proposed Wrought Iron'Fence is totally unacceptable.
• In the plans, it shows a monument on the east side of the Mansfield entrance. : 'No such
monument exists nor is planned to be built by Bettencourt: If Dame is not going to build a
monument, the Wrought Iron Fence must connect through that area.
• Bettencourt would like to request that the Wrought Iron Fence on the west side of Mansfield
be relocated. We would like the same amount of fencing to extend along the front of Camino
Tassajara to match the fencing on the east side. This is at no additional cost to Dame and will
be much more aesthetically pleasing. At some future date, Bettencourt may extend,that fence
to the PG&E substation.
• Bettencourt would like written assurance that.Dame's Wrought Iron Fence will join up with
the new gate we are in the process of building for the Mansfield entrance. We have shared
gate plans with Dame.
• The proposed split rail fence enclosing the Detention basin is more appropriate to a horse
barn rather than our community as shown in photograph #4. 1
This fence will be adjacent to the tot lot where small children will be playing. Small children
can crawl directly through the openings between the rails and go into the Detention basin.
Larger children will use the fence as a ladder and climb over it. Parents will be the only ones
unable to get through or over the-fence in time to save an injured child. The above Dame
proposed Wrought Iron Fence would be acceptable in place of the split rail fence 'around the
detention basin.
The Dame proposed split rail fence is totally unacceptable and will endanger our children. A�

• On the submitted plans there is no detail/elevation on the bridges to be built. We have no
way of knowing what will be installed. Based on the condition of the rest of the plan, we
have no confidence the bridges will be acceptable. We require detailed specifications. In
addition, we require written assurance that the path and the bridges to the tot lot field will
conform to the Americans with Disabilities Act which will allow our wheelchair bound
residents access to this park.
• The proposed play equipment is substandard and not consistent with our existing Tot Lot.
The proposed play equipment is more appropriate to someone's back yard and is made of
wood which is dangerous and requires high maintenance. For consistency we would like the
exact same metal play equipment (Burke model 2000-418) which currently exists in the tot*lot
located at our cabana.
• The slope of the embankment to the wetlands requires that guard rails be installed on the
sides of the path leading to the park and that fencing be installed to prevent children from
falling into the wetland area. This fencing should match that used for the Detention area but
could be lower.
Please see the attached A. S. Dutchover & Associates letter which reviews the above concerns as
well as other issues.
What Dame is proposing'will lower the property values in Bettencourt and will endanger our
children. We demand that you prevent this travesty which is in no way consistent with your
intent in approving Dame's application. Please require Dame to deliver plans which are
consistent with other communities in this area.
Bettencourt reserves the right to reassess any revised Dame plans and the county's review as well
as to publicly comment.
