C.87 LETTER, dated July 29, 1996, received from John Fulwider, Don Black, Margaret Wiley,
Hugh Afshar, and Michael Johnston, c/o 6975 Johnston Road, Pleasanton, CA 94588-
9593,property owners, Pleasanton Area, referring to an application of Wilbert Perry to
subdivide his property on Johnston Road, Pleasanton, and requesting the imposition of a
condition for a grant of easement on the west side of the creek through the Perry property.

would enable Contra Costa County to become a Certified United Program Agency (CUPA)
for the Risk Management Plan (RMP).

Jim Jakel With these factors considered, we join in support of SB 1889 (Calderon)which would
delegate authority for the Federal Risk Management Program(RMP) through the State
Office of Emergency Services to the County and other CUPAs.
The RMP addresses the issues raised in the recent public hearings related to industrial
safety including worker certification and training, construction, maintenance, and
inspection by the administering agencies. The RMP was written following extensive
study of the causes of industrial incidents nationwide. The RMP, which goes beyond
the state's Risk Management and Prevention Program (RMPP)by including
flammables, has a number of elements which impact nearly every operational aspect of
running an industrial facility. Included are requirements for how equipment is
fabricated, installed, maintained, and replaced to prevent failures and accidental

releases. It provides the administering agency with additional inspection powers and regulates
the actions of contractors working at the facility.
It is our position that the RMP should be administered by local authorities, such as the county,
to better respond to the community.
We will look forward to doing all that we can to support the county's effort to become an
administering agency for the RMP.
