SUBJECT: Park Dedication Ordinance and Policies;
County Service Area R-7
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Order Director of Planning to respond to letter dated July 26, 1983 from the Mayor,
City of San Ramon, based on the following recommendations if adopted by the Board,
indicating Board policy regarding the collection and disbursement of Park Dedication
Fees within the City of San Ramon.
2. Order Public Works Director to respond to letter dated July 26, 1983 from the Mayor,
City of San Ramon, providing a status report on the recommended division of Service
Area R-7, noting the involvement of Supervisor Schroder in plans to revise the
boundaries of Service Area R-7, and noting that the Internal Operations Committee
will make further recommendations to the Board after receiving a final report from
the Public Works Department on this subject.
3. Approve the following recommendations of the Park and. Recreation Facilities Advisory
Committee as transmitted by the Director of Planning:
a. The park dedication fee is to continue to represent the value of park land, not
the cost of park development. The basic dedication is to be 350 square feet of
land per dwelling unit.
b. The in-lieu fee is increased to $400 per dwelling, which represents a land value
of approximately $50,000 per acre. The same fee is to apply to all types of
dwelling units and in all parts of the County.
c. The specific amount of dedication of land or fees is to continue to be included
in the Ordinance, and should not be based on a sliding scale of any sort. A
review is to be conducted every two years.
d. General Plan updates for the several planning areas in the County are to include
an update of the Recreation Element. The schedule referred to in Recommendation f
below, is to be prepared in accordance with the Recreation Element. A review of
the entire Element is to be undertaken in 1984.
e. Fee funds should continue to be transferred to service areas and special districts
on a project basis by order of the Board of Supervisors.
f. A state requirement for the preparation of a schedule specifying how and when park
or recreational facilities will be developed is to be prepared by'the Park and
Recreation Facilities Advisory Committee through the Planning Department.

g. Ordinance provisions which specify refunds under certain circumstances
are to be delegated to the Director., of Planning.
h. The entire Ordinance should be updated to reflect other changes in the law.
i. The following policy statements reflect the Board's intent .regarding the use
of park dedication funds and are to act as a guideline to County staff, and
park districts and service areas:
(1 ) Park dedication funds will be used to acquire ordevelop park and
recreational facilities based on specific authorizations by the Board.
The only exception is where funds collected in areas annexed by a city
are transferred to the city.
(2) Park dedication funds shall not be used for operations or maintenance.
(3) Park dedication funds are to be used to provide neighborhood and community
park and recreation facilities and equipment that conform with the
standards and intent of the Recreation Element of the General Plan.
Therefore, requests should be comprehensive and significant rather than
piecemeal and frequent.
4. The Director of Planning is to return to the 1984 Internal Operations Committee
by April 15, 1984 with a comprehensive report which identifies the Park Dedication
Fee charged by each city in Contra Costa County and which reviews these fees in
the perspective of the total level of fees charged to a developer per dwelling c
unit in the County and each city for such items as fire service, schools and
infrastructure improvements. This report should also include a review and
recommendation on the feasibility and advisability of establishing higher
Park Dedication Fees in specific zones within the County where new development
is or is expected to be heavy in the near future, thereby placing unusual demands
on community resources.
5. Direct the Public Works Director to report to our Committee as soon as possible
on his recommendations for the future of County Service Area R-7.
BACKGROUND/JUSTIFICATION:
On August 9, 1983, the Board referred to our Committee a July 26, 1983 letter from
Diane Schinnerer, Mayor, City of San Ramon, recommending that the Park Dedication
Ordinance be brought up-to-date with recent State law changes; that the County make
direct payments to the responsible agency and divide the remaining County Service
Area R-7 into two units (Alamo and Bishop Ranch) with separate advisory committees.
On August 30, 1983, the Board referred to our Committee a report transmitted by the
Director of Planning from the Park and Recreation Facilities Advisory Committee making
certain recommendations regarding changes in the Park Dedication Ordinance to conform
it to recent changes in State law and to increase the Park Dedication in-lieu fee.
On October 17, our Committee considered both Mayor Schinnerer's letter and the report
from the Director of Planning. We agree that an increase in the fee to $400 is
appropriate at this time.
We have attached a list of projects funded over the past several years by the Park
Dedication Fee.
We are concerned about the widely varying fee charged by different cities in the County,
but also recognize that many other fees must be reviewed in order to gain an accurate
picture of the total fees charged per dwelling unit.
The incorporation of Danville and San Ramon have cut into the territory previously
in County Service Area R-7. There are now two distinct areas remaining; one including
Alamo and the other including the Bishop Ranch area. Public Works staff have been
working closely with Supervisor Schroder on recommendations to divide this remaining
territory into two separate areas with separate advisory committees. Our Committee is
inclined to agree with these recommendations, but we want to see a final report from
Public Works on this subject before making definitive recommendations to the Board.
