MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: August 13, 1996 SUBJECT: Reject Bids Received on July 23, 1996, for the EI Toyonal Bridge Replacement Project, Orinda area, Project No.: 0662-6U4016-95 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Bruno Design t he"�slat this is a true and medsoapfr of Project Bidder-via Public Works an moon taken end ernered on the inhAn of the saw of an as date of supenAe=owaZiAtodwsw ey oar Reject Bids Received on July 23, 1996, for the EI Toyonal Bridge Replacement Project, Orinda area Page 2 August 13, 1996 WAIVE the County Minority Business Enterprise and Women Enterprise Program requirements for construction contract, purchasing and professional service contracts; and, DIRECT the Public Works Director to take appropriate actions to provide opportunities for minority and women-owned businesses to participate in bidding on any contract work and/or materials, and in the selection of any consultants associated with the repair; and, AUTHORIZE the Public Works Director to take the necessary actions and use all available resources to replace the bridge as soon as possible. II. Financial Impact: There is no impact to the General Fund. III. Reasons for Recommendations and Background: Rejection of the bid is in the County's best interest, and the Public Works Department recommends that the bid be rejected. Pursuant to Public Contract Code Section 20393, as well as the Notice to Contractors, the Board in its discretion may reject all bids. Due to the poor condition of the bridge it cannot be used as an emergency evacuation route. The County wishes to construct the emergency evacuation route prior to this winter, re- advertising the project through a competitive bidding process would not allow for the completion of the bridge prior to winter. Therefore, the Public Works Department will utilize its own resources to construct the bridge this fall. IV. Consequences of Negative Action: . If the bid is not rejected, the bid remains valid for another ten days. This could affect the bidder's ability to bid other work. Not declaring the situation an emergency will significantly and adversely, delay replacement of the bridge and establishment of the emergency evacuation route.
