Code § 8335) SUBJECT: Vacation of a Portion of Brookside Drive W.0. 4059 North Richmond Area The Board of Supervisors of Contra Costa County RESOLVES THAT: This summary vacation of an excess right of way of a street or highway no longer required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This vacation request is for a portion of a roadway located in the North Richmond area. A description of the portion to be vacated is attached hereto as Exhibit "A" and incorporated herein by reference. This vacation request is part of a larger project for which an EIR was prepared and approved by the Board. The project has been determined to conform to the County's General Plan. This vacation request is based on the fact that the street or highway has been superseded by relocation (S. & H. Code Section 8330). RESOLUTION NO. 96/ 365 This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a public highway. RW0564D-96 EXHIBIT"A" PARCEL A: Real property in an unincorporated area of Contra Costa County, California, being a portion of Brookside Drive (formerly Road No. 17) and a portion of Lot 199 as shown on the map entitled "Map of the San Pablo Rancho, Accompanying and Forming a Part of the Final Report of the Referees in Partition," filed March 1, 1894, in the Office of the County Recorder of said County, described as follows: Beginning at the southwest comer of Lot A as shown on the map entitled "Map of the Sampson Tams Ranch,"filed July 1, 1907, in Book 1 of Maps at page 7, records of said County; thence, from the Point of Beginning, along the east line of Lot B as shown on said map (1 M7), said line being the westerly right of way line of Brookside Drive, south 0038'18"west 290.45 feet; thence, leaving said line, north 58°59'16" east 46.99 feet to a point on the west line of Lot 199 as shown on said Map of the San Pablo Rancho, said point being the easterly right of way line of Brookside Drive, said point also being the southwl2st corner of PARCEL 5A described in the deed to Contra Costa County recorded April 5, 1996, at Series Number 96-62532; thence, along the west line of Lot 199, north 0°38'18" east 118.50 feet to the southwest comer of the parcel of land described in the Final Order of Condemnation in favor of Contra Costa County recorded May 1, 1996, at Series Number 96-80616 records of said County;thence, along the exterior boundary of said Contra Costa County parcel (96-80616), north 0038'18" east 18.29 feet; thence, leaving said west line of Lot 199, continuing along the exterior boundary of said Contra Costa County parcel (96-80616), northerly, northeasterly, and southeasterly along the arc of a tangent curve concave to the southeast, having a radius of 45.00 feet, through a central angle of 113014'16", a distance of 88.94 feet to a point on the southerly right of way line of Brookside Drive; thence, along the southerly right of way line, south 66°07'26"east 228.17 feet to the intersection with the southerly prolongation of the easterly line of said Lot A (1 M7); thence, northerly along said southerly prolongation, north 0°38'18" east 43.53 feet to the southeast comer of said Lot A(1 M7), said point lying on the northerly right of way line of Brookside Drive; thence, along said northerly right of way line, north 66°07'26"west 340.00 feet to the Point of Beginning. Containing an area of 23,713 square feet of land, more or less. RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain, operate, replace, remove and renew those existing and in place utilities, as of the date of recording this instrument, in, upon, over and across any highway or part thereof proposed to be vacated, including access to protect the property from all hazards, in, upon, and over the area herein before described to be vacated.
