BRAGDON DIRECTOR OF COMMUNITY DEVELOPMENT STA co DATE: July 23 , 1996 SUBJECT: Hearing on P-1 Rezoning and Preliminary Development Plan Application #RZ953034 and Companion Final Development Plan #953088 to. Rezone Approximately 1.04 acre property from General Agriculture (A-2) to Planned Unit District (P-1) for a maximum of four (4) lots. Subject property front for approximately 225 feet on the south side of Nutmeg Drive and for approximately 196 feet on the west side of O'Hara Avenue, in the Oakley area. Application filed by Bellecci & Associates (Applicant) - HPH Homebuilders (Owners) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS In accord with the recommendation of the East County Regional Planning Commission: 1. Adopt the Negative Declaration prepared for this project as adequate and complete. 2 . Approve Rezoning RZ953034 and Final Development Plan DP953088 subject to conditions as recommended by the East County Regional Planning Commission as shown on Exhibit A. 3 . Adopt the East County Regional Planning Commission findings as set forth in Resolution No. 13-1996 as the basis for the Board's determination for this action. 4 . Introduce ordinance giving effect to the aforesaid rezoning, waive reading and set date for adoption of same. 5. Direct staff to post the Notice of Determination with ;the County Clerk for the above action. 6. Grant full credit for required Park Dedication as recommended by the East County Regional Planning Commission. BACKGROUND/REASON FOR RECOMMENDATION The applications for this project were filed with the County on November 15, 1995. The applications consist of a P-1 rezoning request and preliminary development plan (RZ953034) , a final development plan (DP953088) and a vesting tentative map for a four (4) parcel minor subdivision (MS 950007) . The site is surrounded on three sides by a P-1 subdivision (SUB 7640) under construction at this time. On July 1, 1996 the East County Regional Planning Commission, after taking testimony at a noticed public hearing, recommended that the Board approve this development subject to conditions. The East County Regional Planning Commission closed the hearing on MS 950007 and set August 5, 1996 as the date of decision pending the Board' s approval of RZ953034 and DP953088. The East County Regional Planning Commission also recommended, that since the neighboring development (SUB 7640) is being developed by the same developer, and since the development dedicated 2 .54 acres of land for park purposes (one acre required) next to the elementary school on Mercedes Lane, that the developer be given credit for the park land dedication. Thus, the requirement for the $1,350. 00 per vacant parcel park fee should be waived. There are three (3) vacant parcels in this development. The original listed owner was County Investors. Hal Porter Homes (HPH) purchased the site from the previous owners. Bellecci & Associates was the applicant for both SUB 7640 and related applications (2943-RZ, DP3002-91) and for this development (RZ953034 , DP953088 and MS 950007) . AB/aa BD1/7-95.AB
