Program Year Alignment Requirement
Contra Costa County HOME Consortium
This is response to the County' s request for a waiver
of the consolidated plan transition period requirements for
consortia which are described at 24 CFR part 91.402 (b) .
Under this provision, a consortium in existence on
February 6, 1995, in which all members do not have aligned
program years, is required to bring the program years into
alignment during a transition period, which is the balance
of the current consortium agreement. Contra Costa County' s
program year had a March 1 starting date, with that of the
other consortium members being July 1 . The County' s current
consortium agreement expires in 1997 .
According to your letter, Contra Costa County is
extending each of four program years, beginning in 1995, by
one month in order to accomplish the transition. As a
consequence, the program year realignment will not be
completed until 1998, which is one year after the expiration
of the current consortium agreement. The reason given by
the County for not completing the realignment within the
term of the current consortium agreement was that this would
necessitate a 14 month program year, which would lead to a
funding shortfall and subsequent hardship to the County and
its CDBG and ESG program subrecipients.
Under 24 CFR 5 . 110, HUD may, subject to statutory
limitations, waive any provisions of Title 24 upon
determination of good cause. The reason provided by Contra
Costa County for undertaking a four-year instead of a
three-year transition period to align its program year with
that of the other consortium members constitutes good cause.
Therefore, pursuant to the authority at 24 CFR 5. 110, HUD
hereby waives the provision contained in section 91.402 (b)
requiring that the transition to align program years within
a consortium be accomplished during the balance of the
current consortium agreement, which for the Contra Costa
Consortium expires in 1997 . Contra Costa County will have
until 1998 to complete its transition.
