Concord Area
The Board of Supervisors, as the Governing Body of the Contra Costa County Flood Control
and Water Conservation District RESOLVES THAT:
District acquired certain real property on January 27, 1978, in Book 8688-of Official Records
at page 700, described in Exhibit "A" attached hereto, for flood control purposes. Said property is
DETERMINED to be surplus and no longer necessary for District or other public purposes and its
estimated value does not exceed $10,000.00.
This Board hereby APPROVES and AUTHORIZES the sale of said property to the City of
Concord, pursuant to Government Code Section 25526.5 and the Board Chair is hereby
AUTHORIZED to execute a Quitclaim Deed on behalf of the District in consideration for the payment
received in full in the amount of$5,000.00, the estimated fair market value of the property.
This Board hereby APPROVES the Right of Way Contract with the City of Concord and
AUTHORIZES the Chief Engineer to execute said contract on behalf of the District.
The Real Property Division is DIRECTED to cause said Deed to be delivered to the grantee.
The Board hereby FINDS that the project will not have a significant effect on the environment,
and DETERMINES that the project is exempt from the requirements of the California Environmental
Quality Act pursuant to Article 5, Section 15061(b)(3) of the State CEQA Guidelines, and DIRECTS
the Director of Community Development to file a Notice of Exemption with the County Clerk and
DIRECTS the Public Works Director to arrange for payment of the $25.00 handling fee to the County
Clerk for filing of the Notice of Exemption.

Real property in the City of Concord, Contra Costa County, California, being a portion of the Rancho
San Miguel, described as follows:
Commencing at the most northerly comer of PARCEL"B"as shown on the Map of"Subdivision 4866,
Fox Meadow", filed March 11, 1977, in Book 193 of Maps at page 37, records of said County; thence,
along the northwesterly line of said PARCEL "B", south 47000'29" west 1.62 feet to the Point of
Beginning; thence, from the Point of Beginning, south 47000'29"west 102.31 feet to a point on the
northeasterly right of way line of Siena Road, said point from which a radial line of a non-tangent
curve, concave to the southwest, having a radius of 397.50 feet bears south 61 046'23"west; thence
along the northeasterly right of way line of Sierra Road, southeasterly along the arc of said curve,
through a central angle of 2011'04", a distance of 15.15 feet; thence southeasterly along the arc of
a reverse curve, concave to the northeast, having a radius of 160.00 feet, through a central angle
of 16058'31", a distance of 47.40 feet; thence southeasterly along the arc of a reverse curve,
concave to the southwest, having a radius of 225.00 feet, through a central angle of 33001'16", a
distance of 129.67 feet; thence southeasterly along the arc of a reverse curve, concave to the

of said County; thence, leaving the northeasterly right of way line of Sierra Road, along the
southeasterly line of said PARCEL"B" (203 M 35) and its northeasterly prolongation, north 53017'59"
east 71.04 feet to a point from which a radial line of a non-tangent curve concave to the northeast,
having a radius of 533.67 feet bears north 24001'48" east; thence leaving the northeasterly
prolongation of the southeasterly line of PARCEL "B", northwesterly along the arc of said curve,
through a central.angle of 57037'08", a distance of 536.68 feet; thence north 8021'04"west 182.13
feet to the Point of Beginning.
RESERVING THEREFROM unto the grantor a nonexclusive floating access easement over all of
PARCEL 1 described above, extending from the southwesterly boundary of the Pine Creek Flood
Control Channel to the northwesterly right of way line of the public road known as Siena Road. The
location of said floating easement to follow driveways or access routes on said PARCEL 1 as they
may be located or relocated in this area from time to time or by such other route mutually agreeable
between the parties hereto.
This parcel is conveyed to the City of.Concord on the express condition it is used only for public
purposes. In the event said property, or any portion thereof, is determined to be no longer needed

for public purposes or such use is discontinued for a continuous period of one (1) year, said property
or portion thereof shall immediately revert to and revest in the Grantor or its successors or assigns.
By acceptance of this deed, Grantee agrees to maintain the chain link right of way fence between
and abutting this property and Grantor's remaining property.
Containing an area of 25,775 square feet of land, more or less.
PARCEL 2:
Real property in the City of Concord, Contra Costa County, California, being a portion of the Rancho
San Miguel, described as follows:
Beginning at the most northerly corner of PARCEL "B" as shown on the Map of"Subdivision 4901,
Sierra Court", filed October 11, 1977, in Book 203 of Maps at page 35, records of said County;
thence, from the Point of Beginning, north 4403633" west 92.57 feet; thence, northwesterly along
the arc of a tangent curve concave to the northeast, having a radius of 472.50 feet, through a central
angle of 0020'17", a distance of 2.79 feet to the most southerly corner of PARCEL "A" as shown on
said Map of"Subdivision 4901, Sierra Court" (203 M 35); thence south 8°17'31" east 34.67 feet;
thence south 61"32'31" east 70.48 feet to the Point of Beginning.
Containing an area of 979 square feet of land, more or less.

OF SURPLUS PROPERTY County File #CP 94-61 : The activity consists of the transfer of title of
surplus Flood Control District (District) property to the City of Concord for park purposes. The
impacts of a mini-park are addressed in a Negative Declaration prepared by the City of Concord
dated June 21, 1994.
The site is approximately 35,000 square feet and will be transferred to the City of Concord with
the stipulation that certain reservations and conditions apply (i.e., District access to the flood
control channel). No new parcel will be created as a jesult of the activity.
Project Location: The property is located in a residential area in the central county area of Concord
and is adjacent to the flood control channel.
This project is exempt from CEQA as a:

The Contra Costa County Community Development Department has completed an initial study of the environmental
significance of the project represented by your pending application bearing County File Number CP 94-61 (Sierra
Road -Transfer of Title of Surplus Property. Concord area). In conformance with Contra Costa County Guidelines
for implementing the California Environmental Quality Act of 1970 (CEQA), it has been determined that your
project will not have a significant effect on the environment. Your project falls within the following category:
V) AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.
( ) The project is categorically exempt (Class ).
( ) The CEQA requirements are accommodated by the EIR previously prepared for
( ) A statement that an EIR is not required (Negative Declaration of Environmental Significance has
been filed by the Community Development Department (unless appealed).
