Contra Costa County (Applicant) - Michael Calpestri (Owner) . SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Approve rezoning application RZ953023 as recommended by the County Planning Commission and/or staff. 2 . Adopt the Planning Commission's reasons or . findings as set forth in its resolution No. 28-1995 as the determination for these actions. 3'. Introduce the ordinance giving effect to the rezoning; waive reading and set date for adoption of same. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS This is a County-initiated proposal to rezone approximately 50 acres of land designated Agricultural Lands by the County General Plan. Presently the existing zoning is U-Unrestricted. The existing zoning only restricts any unlawful activities. Whereas, the General Agricultural zoning district would limit the use to Agricultural and related uses. Page 3-25 of the Land Use Element of the county General Plan presumes that the U (Unrestricted) District will be deleted from the Zoning Ordinance because it is one of four antiquated zoning districts. RMP/aa/df RZ953023 .bo 9/5/95 ADDENDUM TO D.7 September 26, 1995 The Chair opened the hearing on the recommendation of the Contra Costa County Planning Commission on the request of Contra Costa County(applicant) and Michael Calpestri (owner) for approval to rezone approximately 50 acres of land designated Agricultural Lands by the County General Plan. All persons desiring to speak having been heard, the hearing was closed, and the Board considered the recommendations of the Community Development Director. Therefore, IT IS BY THE BOARD ORDERED that the recommendations of the Community Development Director are APPROVED, and that Ordinance No. 95-469iving effect to the rezoning is INTRODUCED, reading waived, and October 3, 1995, is SET for adoption. RESOLUTION NO. 28-1995 RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND RECOMMENDATIONS ON THE REQUESTED CHANGE BY CONTRA COSTA COUNTY (APPLICANT) AND MICHAEL CALPESTRI (OWNER) , (RZ953023) , IN THE ORDINANCE CODE SECTION PERTAINING TO THE PRECISE ZONING FOR THE PITTSBURG AREA OF SAID COUNTY. WHEREAS, a request by Contra Costa County (Applicant) and Michael Calpestri (Owner) (RZ953023) to rezone land in the Pittsburg area from Unrestricted (U) to General Agricultural (A-2) was received on January 9, 1995; and WHEREAS, in connection with applicant's request, an Initial Study of Environmental Significance was prepared by the Community Development Department which determined that the requested entitlements would not have any significant adverse environmental impacts; and WHEREAS, for purposes of compliance with provisions of the California Environmental Quality Act and State and County CEQA guidelines, a Negative Declaration of Environmental Significance was prepared, posted and circulated; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the East County Regional Planning Commission on Monday, May 1, 1995 and rescheduled in order to renotice for June 5, 1995; whereat all persons interested might appear and be heard; and WHEREAS, on Monday, June 5, 1995, the East County Regional Planning Commission having fully reviewed, considered and evaluated all the testimony and evidence submitted in this matter and finds the following: NOW, THEREFORE, BE IT RESOLVED that the East County Regional Planning Commission recommends to the Board of Supervisors of the County of Contra Costa, State of California, that the rezoning request of Contra Costa County (Applicant) and Michael Calpestri (Owner) (RZ953022) be approved for change from Unrestricted (U) to General Agricultural (A-2) , and that this zoning change be made as indicated on the findings map entitled: Page F-19m of the County's 1978 Zoning Map. BE IT FURTHER RESOLVED that the reasons for this recommendation are as follows: 1. The proposed zoning of the site to A-2 conforms to the General Plan designation of Agricultural Lands land use category. RESOLUTION NO. 28-1995 2 . The use authorized or proposed in the land use district are compatible within the district and the uses authorized . in adjacent district. BE IT FURTHER RESOLVED that the Secretary of the East County Regional Planning Commission shall respectively sign and attest the certified copy of this resolution and deliver the same to the Board of Supervisors all in accordance with the Planning Laws of the State of California.
