SUBJECT: ACCEPT BAY CABLEVISION'S FCC FORM 393 (BASIC SERVICE TIER RATES)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ACCEPT the Federal Communications Commission (FCC) Form 393 submitted by Bay
Cablevision for the Basic Service Tier Rates effective after September, 1993.
FINANCIAL IMPACT:
None.
BACKGROUND:
On or about July 8, 1994, Bay Cablevision submitted a Federal Communications
Commission (FCC) Form 393 to the Cable TV Administrator for review by the County
(certified to regulate the basic service tier rates in August, 1993). The review time for the
FCC Form 393 was tolled by the Board of Supervisors for ninety (90) days pursuant to
Section 76.933(b) of the FCC rate regulations.
Since additional time was needed for review, Bay Cablevision consented in writing to a
further tolling of the review until March 31, 1995. The Board then adopted an accounting
order to further extend the review period to provide time to receive and review additional
documentation.

After completing the review and receiving the requested letter that states there were no
material year-end financial adjustments in 1994 for Bay Cablevision, staff determined that
although Bay Cablevision had charged rates over those permitted by the FCC, recent FCC
rulings prevented issuing a refund order for a period more than one year from the refund
order.
Therefore, staff recommends that the Board accept the FCC Form 393 submitted by Bay
Cablevision.
