I. RECOMMENDED ACTION:
APPROVE Project, and
DETERMINE that the project is a California Environmental Quality Act Class 1c
Categorical Exemption, and
DIRECT the Public Works Director to begin right-of-way acquisition and to
prepare contract plans and specifications for construction.
DIRECT the Director of Community Development to file a Notice of Exemption
with the County Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00
handling fee to the County Clerk for filing of the Notice of Exemption.

II. FINANCIAL IMPACT:
The estimated project cost is approximately $ 250,000.00, funded by SB 300
(5%), Redevelopment Funds (30%), CDBG Grant (5%), Bay Point AOB (30%),
Keller Canyon Mitigation Fees (30%). The final percentages may vary slightly.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes installing a storm drain and inlets, widening to provide
frontage improvements including curb, gutter, and sidewalk, and overlaying the
road with asphalt concrete.
It is needed to improve drainage and provide frontage improvements.
The project has been determined to be in compliance with the General Plan
because it consists of minor alterations of existing public facilities involving no
expansion of use per Section 15301 of the CEQA Guidelines.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction
and may jeopardize funding.

The project consists of minor roadway improvements with the following features:
1) Widening portions of the west side of Alves Lane from Willow Pass Road to Water Street;
2) Installation of approximately 900 linear feet of storm drain pipe from Willow Pass Road to Water Street;
3) Installation of curb and gutter and sidewalks where needed; "
4) Installation of curb ramps, driveway conforms, and retaining walls where needed; and
5) Overlay roadway and stripe.
Subject project is located as follows: The project is located in the central County area of Bay Point. The
existing land use along Alves Lane is a combination of residential, business, and recreational facilities.
This project is exempt from CEOA as a:
Ministerial Project (Sec. 15268) _ Other Statutory Exemption, Section _
Declared Emergency (Sec. 15269(a)) _ General Rule of Applicability(Section 15061(b)(3))
Emergency Project (Sec. 15269(b) or (c))

for the following reason(s): The project will not have a significant effect on the environment. The project
consists of minor roadway widening and associated improvements, and the installation of a storm drain line.
This is a minor alteration of existing facilities resulting in a negligible expansion of use. All work will be
performed within the existing right-of-way except for a small amount of right-of-way to be acquired for curb
returns. The proposed project will not result in the removal of any scenic resource.

Community Development staff has reviewed the attached project, CP 95-9,q" to determine
if mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
( This project has been determined to be exempt from 65402 review.
( ) This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
( ) This project should be referred to the City of for 65402 review.
( ) Community Development staff makes the following attached recommendation
which should be incorporated into the staff report on this matter.

The Contra Costa County Community Development Department has completed an initial study of the environmental
significance of the project represented by your pending application bearing County File Number CP 95-49(Alves
Lane Widening). In conformance with Contra Costa County Guidelines for implementing the California
Environmental Quality Act of 1970 (CEQA), it has been determined that your project will not have a significant
effect on the environment. Your project falls within the following category:
