No. 1834 RESOLUTION NO. 95/418 Bay Point Area Resolution of Summary Vacation) (S. & H. Code § 8335) The Board of Supervisors of Contra Costa County RESOLVES THAT: This summary vacation of an excess right of way of a street or highway no longer required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This vacation request is for excess right of way on Port Chicago Highway located in the Bay Point area. A description and map of the portion to be vacated are attached hereto as Exhibit "A" and Exhibit "B" and incorporated herein by reference. The vacation request is for an excess right of way of a street not required for street purposes (S. & H. Code Section 8334). RESOLUTION NO. 951418 The Board REVIEWED and APPROVED the vacation of a portion of Port Chicago Highway on October 3, 1989, and FOUND the vacation would have a significant effect on the environment and that an EIR was prepared and circulated pursuant to State Law and County CEQA Guidelines. A Notice of Determination was filed with the County Clerk. The Planning Commission FOUND pursuant to Government Code Section 65402 that this vacation was in conformance with the general plan. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a public highway. The Real Property Division is ORDERED to record a certified copy of this Resolution in the office of the County Recorder.
