The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330.
This vacation request is for excess right of way on Port Chicago Highway located in the
Bay Point area. A description and map of the portion to be vacated are attached hereto as Exhibit
"A" and Exhibit "B" and incorporated herein by reference.
The vacation request is for an excess right of way of a street not required for street
purposes (S. & H. Code Section 8334).
RESOLUTION NO. 951418
The Board REVIEWED and APPROVED the vacation of a portion of Port Chicago Highway
on October 3, 1989, and FOUND the vacation would have a significant effect on the environment
and that an EIR was prepared and circulated pursuant to State Law and County CEQA
Guidelines. A Notice of Determination was filed with the County Clerk. The Planning
Commission FOUND pursuant to Government Code Section 65402 that this vacation was in
conformance with the general plan.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer
constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in
the office of the County Recorder.

Real property in an unincorporated area of Bay Point, Contra Costa County, California, being a
portion of the southeast quarter of Section 5 and a portion of the northeast quarter of Section 8,
Township 2 North, Range 1 West, Mount Diablo Meridian, described as follows:
Commencing in the intersection of Port Chicago Highway and Nichols Road at the Contra Costa
County monument marking the northeast corner of Section 8 (T2N, R1 W) as said monument is
shown on the Record of Survey"Land Acquisition Line, Naval Weapons Station, Concord, California"
filed November 15, 1982 in Book 71 of Licensed Surveyors Maps at page 25, sheet 3 of 11 sheets,
records of said County; thence from said monument along the north line of Section 8, north
88052'13"west 35.00 feet, to the Point of Beginning on the southerly prolongation of the west right
of way line of Nichols Road; thence from the Point of Beginning along said prolongation, south
101 3'56' west 50.00 feet, to the south right of way line of Port Chicago Highway; thence along said
south line, north 88052'13"west 463.20 feet, to the southeast corner of Parcel One described in the
Vacation by Contra Costa County recorded February 12, 1990 in Volume 15653 at page 654, Official
Records of said County; thence along the east line of said Parcel One (15653 O.R. 654), north
1°07'4T' east 50.00 feet, to the north right of way line of Port Chicago Highway, also being the north
line of said Section 8; thence along said common line, south 88052'13" east 443.33 feet, to a curve
concave to the northwest having a radius of 20.00 feet; thence leaving the north line of Section 8,
continuing along the north line of Port Chicago Highway, being the arc of said curve, easterly,
northeasterly and northerly 31.38 feet, through a central angle of 89053'51" to a point of cusp on
the west right of way line of Nichols Road; thence along the southerly prolongation of the west right
of way line of Nichols Road, south 1013'56" west 19.96 feet, to the Point of Beginning.
Containing an area of 23,248 square feet (0.5337 acre) of land, more or less.
Bearings and distances are based on the California Coordinate System Zone Ill (CCS 27). Multiply
given distances by 1.0000581 to obtain ground distances.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways
Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain,
operate, replace, remove and renew those existing and in place utilities, as of the date of recording
this instrument, in, upon, over and across any highway or part thereof proposed to be vacated,
including access to protect the property from all hazards in, upon, and over the area herein before
described to be vacated.
