Contra -, c FROM: Costa Phil Batchelor, County Administrator ;z County DATE: September 12, 1995 SUBJECT: Status of Recovery from the Fire at the Walnut Creek/Danville Municipal Court SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1. ACCEPT report on actions taken with regard to fire recovery; and 2. APPROVE recommendations of the Director of General Services. BACKGROUND: Since August 28, 1995 when the fire occurred at the 640 Ygnacio Valley Road, Walnut Creek court facility, actions have been taken to keep the courts in operation and accomplish the clean-up and repair of the court building. A commercial restoration firm, Paul Davis Systems of Benicia, California has been hired to undertake the clean-up and repairs on an emergency basis. The first floor housing the Clerk's office, jury assembly area and one courtroom incurred smoke and water damage. The contractor has committed substantial resources to the project which has allowed for the entire first floor to be available for court use by September 11, 1995. Water damaged files are being freeze dried in order to dry and preserve the court records. Modifications have been made over the Labor Day weekend to the adjacent office building owned by the County, so that the Court can continue to-operate without the need to locate temporary rental space. The second floor of the court building was seriously damaged by fire, smoke and water. The contractor estimates that it will require approximately three months to complete the necessary repairs to restore full operations. The current estimate for the total cost of the repairs and equipment replacement is in excess of $1,000,000. The court staff are operating under extremely difficult operational conditions while trying to minimize the impact upon the public. The response and cooperation of . court staff, General Services and others during the emergency has been outstanding and certainly deserves recognition. RECOMMENDATION RATIFY AND CONFIRM that an emergency exists, make below recommended findings, approve General Services Director' s below indicated actions from August 28, 1995 to this date and AUTHORIZE the Director of General Services to proceed in the most expeditious manner, pursuant to Sections 20134 or 22050 of the Public Contract Code, to repair the fire damage at the Walnut Creek-Danville Judicial District Courts Building, 640 Ygnacio Valley Road, Walnut Creek, and to provide temporary facilities as required to maintain county operations while repairs are made, and DECLARE that the project, as an emergency, is exempt from the provisions of . the California Environmental Quality Act under Section 15269 (c) of the State CEQA guidelines . II . FINANCIAL IMPACT Subject to a $10,000 . 00 deductible, fire damage control and repair costs are covered by the County Property Damage Trust Fund up to $50,000 . 00 and by the County CSAC Excess Insurance Authority Property Insurance Policy over $50,000 . 00 . III . BACKGROUND A. On Monday, August 28, 1995, the Walnut Creek-Danville Judicial District courts building at 640 Ygnacio Valley Road, Walnut Creek, was severely damaged by fire, rendering the building unusable. The building houses four courtrooms and support functions . B. To permit the continued conduct of court operations and services, emergency temporary accommodations are being arranged; fire, smoke and water damage must be controlled; and damage must be repaired in the shortest possi time. The Director of General Services has initiated actions to secure and assist with the fire damaged premises ' repair and to provide temporary court accommodations . D. Using the normal design and bid process, repairs could not begin for approximately three months . The normal procedures for bidding don't apply and repairs can begin immediately pursuant to provisions of Sections 20134 or 22050 of the Public Contract Code, when the appropriate findings of an emergency are made by the Board. E. It is recommended that the Board (as of August 28, 1995 and to this date) make such findings; direct the Director of General Services to proceed with the project and enter into any necessary contracts; and declare that, as an emergency, the project is not subject to the provisions of the California Environmental Quality Act (Public Resources Code 21080) . F. It is further recommended that the Board find, based upon substantial evidence before it as set forth in the minutes of this meeting, that: ( 1) This emergency will not permit a delay resulting from a competitive solicitation for bids; (2) This action is necessary to respond to the emergency.
