1. Accept report from the County Counsel.

hearing officer decisions be mailed by certified mail, return-receipt requested.
FISCAL IMPACT
Amending the County's mobilehome space rent stabilization ordinance will necessitate the
usual ordinance costs of printing, publication, etc.

On August 8, 1995, the Board requested that this office address certain issues concerning the
County's Mobilehome Space Rent Stabilization Ordinance. The Board also requested that we contact the
management of two mobilehome parks in the unincorporated area of the County. This report is submitted
in response to the Board's August 8, 1995 requests.
1. Communication with Sun Valley Village and Concord Cascade.
The Board requested that this office communicate with Sun Valley Village and Manufacture Home
Communities, Inc. (Concord Cascade) regarding form rent increase notices sent by or circulating in the
parks. Attached are copies of letters sent by this office to the management of Sun Valley Village and
Concord Cascade.
2. Amendment to Section 540-2.814 regarding hearing office decisions.
We understand that there may be a concern that a hearing officer may choose to grant a rent
increase by not rendering a decision due to the default rent increase provision in section 540-2.814(h). The
20-working-day default rent increase provision was included at section 540-2.814(h) as a means of avoiding
"confiscatory" results. Section 520-2.814(d) requires the decision to be rendered and mailed within 15
working days.
We understand that there is also a concern that if a written decision is mailed by ordinary U.S. Mail,
there will be no proof of receipt. Therefore, it has been suggested that section 540-2.814 be amended to
require the decision to be mailed by certified mail, return-receipt requested, to the park owner's and
mobilehome owners' representatives.
We note that nothing in the ordinance prevents the hearing officer from mailing a decision by certified
mail, return-receipt requested. In other words, this concern can be addressed administratively. However,
if an ordinance amendment is considered necessary, we suggest that subdivision (d) be amended to read:
"(d) Hearing Findings and Determination. The Hearing Officer shall, within fifteen (15)working days
of the conclusion of the hearing, submit a written statement of decisions the reasons

Officer. The Hearing Officer may allow the parties to submit briefs or additional information; however,
any such submittal shall not prolong the decision except upon the written waiver of the park owner.
The Hearing Officer's decision shall determine the amount of rent increase, if any, and the effective
date of the rent increase consistent with providing a fair and reasonable return on the involved park
owner's investment."
If the Board supports an amendment to the ordinance, we will prepare an ordinance for formal
introduction and adoption by the Board.
3. Rent increase for capital improvements completed before September 20, 1994.
Our opinion is requested as to whether a park owner may seek a rent increase for capital
improvements completed before September 20, 1994. The ordinance provides for two categories of rent
increases that are not automatic- "capital improvement rent increases" and "major rent increases." Capital
improvement rent increases are advantages to the park owner in certain respects. For example, a capital
improvement rent increase may be approved before any actual expenditure, and there are limitations on
certain grounds for contesting a capital improvement rent increase. Capital improvement rent increases also
differ from major rent increases in that they are of limited duration. Major rent increases are permanently
added to the base rent.
In order to be eligible for a capital improvement rent increase under Article 540-2.12, all of the criteria
in section 540-2.1204 must be met, including section 540-2.1204(x)(1), which requires that the work be
completed on or after September 20, 1994. Therefore, work completed before September 20, 1994 will not

be eligible for a capital improvement rent increase.
However, costs of capital improvements completed before September 20, 1994 are a proper subject
of consideration in connection with a major rent increase. (Article 540-2.10.) This is especially the case since
a rent moratorium had been in effect prior to the adoption of the ordinance.
4. What constitutes a capital improvement.
We have been requested to clarify what is a capital expenditure as opposed to an operating expense.
The ordinance defines "capital improvements" as those expenditures that may be characterized as capital
improvements for federal income tax purposes. (Ord. Code, § 540-2.204(c).) In addition, in order for an
expenditure to qualify for a capital improvement rent increase, the owner must sign a declaration under
penalty of perjury that the owner has or will treat the expenditure as a capital improvement for federal income
tax purposes. (Ord. Code, § 5404-2.1204(c).)
Finally, it has been pointed out that there are three columns under the "Asset Life in Years"table. The
three columns is a result of a computer/printing error. It was corrected in the "final" adopted ordinance.

This rent increase is consistent with the standard rent increase limitation

main .clubhouse to discuss this rent increase on Thursday,
August 10, 1995 at 7:30 p.m.
You are hereby notified that the property owner hereby reserves and is not
waiving any right to impose a capital improvement rent increase with respect
to capital improvements completed at the property during the twenty-four (24)
months prior to the effective date of the Contra Costa County Ordinance and
that the property owner intends to seek a ruling from the County of Contra
Costa or other legal interpretation with respect to such a capital.improvement
rent increase.

On August 8, 1995, the Contra Costa County Board of Supervisors requested
that this office review any initial rent increase notice that may be issued by Sun Valley
Village to assist you with complying with the requirements of the County's Mobilehome
Space Rent Stabilization Ordinance.
We have reviewed the attached sample notice. If you intend to send the
attached sample notice, in our opinion, it does not comply with the County's
ordinance's notice requirements in the following respects.
1. The attached notice does not inform the residents of the time and place of
an informal meeting as required by Ordinance Code section 540-4.602(a)(1).
2. To the extent that 3 % (of the 5.25 %) of the increase noted in the attached
notice is attributable to the standard allowable increase, the notice does not include a
statement that the park owner considers the 3% rent increase consistent with the
standard rent increase limitations of section 540-2.404. (Ord. Code, § 540-
2.602(a)(2)(A)•)
3. The basis for the remaining 2.25 %.is also unclear. If it is the park owner's
intent to notice a major rent increase, the notice should include such a statement in
addition to stating the amount being sought as a major rent increase, both in dollars
and as a percentage of existing space rent, and facts supporting the increase. (Ord.
Code, § 540-2.602(a)(5).)
County Ordinance Code section 540-2.604 provides that any rent increase
imposed without providing a notice that substantially complies with the requirements of

section 540-2.602, or without holding a meeting shall be void and invalid.

Dear Resident:
Effective November 1, 1995, the rent on space number Z 3 will be increased
to $ Your new rent reflects a three percent (3%) increase of X30
per month to the base rent, which the park owner considers consistent with the standard rent
increase limitations of Section 540-2,404 of the Contra- Costa County Mobilehome Rent
Stabilization Ordinance, Beginning November 1, 1995 and continuing on a monthly basis through
Octobea'31, 1996 you will be charged the sum of$ Z/_1 which reflects a two and 1/4
pent (2.2596) incrtase for the period of February 1, 1995 through October 31, 1995. As you
are aware, the park owner generally has increase rents at the park on or about February 1 of each
year. During 1995 the County of Contra Costa placed a freeze on rent increase pending review,
and ultimately adoption, of the County's rent stabilization ordinance. Give the ordinance's
recognition of a three percent (3%) rent increase as an acceptable standard increase, this increase
is to compensate the park for lost rent revenues from February 1, 1995 through November 1, 1995
since the park owner was not able to institute his planned rent increase on February 1, 1995, This
additional rent increase of two and 1/4 percent (2.25%) is a charge for one year only. It will nd

be reflected in your base rent for future consideration. As, stated in the original notice of rent
increase dated the above stated rent increase shall become
effective on November 1, 1995 pursuant to Section 798.30 of the California Civil Code.
