1 . Acknowledge receipt of the monthly progress report (No. 35

Associates, Construction Managers on the status of the
Merrithew Memorial Hospital Replacement Project; and
2 . Acknowledge receipt of Monthly Report No. 4, dated July,
prepared by Davillier-Sloan, Inc. , on Contract Compliance
Services .
BACKGROUND
The contract for construction management with O'Brien-Krietzberg &
Associates for the Merrithew Memorial Hospital Replacement Project
requires a monthly status report to be filed with the Project
Director in the Office of the County Administrator. In addition,
the monthly report, prepared by the consultant, Davillier-Sloan,
Inc. , on the contractors ' compliance with the MBE/WBE and
affirmative action contract requirements, is attached. A copy of
the monthly report is provided to the Clerk of the Board and the
Board of Supervisors for information purposes .

Subject : MBE/WBE and AA/EEO Progress Report
You have before you the progress report for July 1995 on the
Minority and Women Business Enterprise Program (MBE and WBE) and
Affirmative Action/Equal Employment Opportunity (AA/EEO) workforce
at the Merrithew Memorial Replacement Hospital Project . Centex
Golden has been commended on their continued efforts to meet the
14% MBE goal and 60 WBE goal by increasing MBE and WBE
participation on this project. There has been an additional
$531, 785 awarded to minority owned firms and $485; 000 awarded to
women owned firms since the award of the contract . This brings the
total MBE participation from $1, 241, 500 (3 . 140) to $1, 773, 285
(4 .49%) and WBE participation from $186, 000 ( .470) to $671, 000
(1 . 70%) .
Physical construction on the Replacement Hospital began July 3 ,
1995 . Employment data for the month of July has been evaluated and
will .appear in your August monthly, report . The data indicates
there were seven trades for a total of twenty three workers . We
have exceeded our minority participation goals with 878 (44 . 8%)
minority work hours . We are currently below our female goal with
15 ( . 80) female work hours . The analysis by trades indicates :

Although the bid specification does not require monitoring the
usage of local (geographically located in Contra Costa County)
hires (workers) ; with the assistance and cooperation of Centex
Golden, we have developed procedures to monitor local employment
participation.
Local employment participation data indicates 895 (45 . 60) work
hours on this project in July 1995 . The data indicates we have
exceeded both our AA/EEO goals of 25 . 70 minority and 6 . 90 female
. participation for local participation.
Goals are also monitored by contractor and all subcontractors . We
will have an analysis for you in our August 1995 Progress report
along with a weekly analysis .
The results of our July 1995 efforts for MBE and WEE participation
and our partial review of our employment participation on this
' project are presented to you for your review and comments . We will
continue to keep you informed on the selection of MBE/WBE firms and
AA/EEO participation on this project .

MONTHLY PROGRESS REPORT
Project Status:
Construction on the new hospital began July 13th with mass excavation and site
shoring. Progress continued in August with the milestone of "bottoming out"
or completion of mass excavation having been achieved. Some minor issues
required resolution at the retaining wall along I-Ward. Foundation and
retaining wall work continues with waterproofing and rebar installation.
Placement of foundation concrete is soon to follow. Structural steel has
arrived at the steel mill and fabrication will begin in September.
The equipment planning consultant, Facilities Development Inc., (FDI) ,
completed its inventory and asset tagging of major fixed and moveable
equipment. The effort included an assessment of each device's condition,
i.e., good/fair/poor. The hospital staff will be reviewing this list and
making final judgement on the "re-useability" of the equipment. Once this
process is complete, a more precise figure of the inventory value will be
available for adjustment to the overall equipment budget.
A request for qualifications for a telecommunications consultant was developed
and distributed on August 24th. The proposals are due October 6th. The
consultant will be required to prepare a detailed specification for bidding
the telecommunications work.
Budget:
The total project budget is $81,841,000. The favorable construction bid
provided for adequate contingencies for the construction. As of the end of
August, approximately $3, 000,000 of construction has been completed on the
current contract with Centex Golden.
Schedule:
The overall program schedule has been simplified into a 1 page bar chart (see
following page) which reflects a hospital construction completion date of July
29, 1997.

Issues:
Structural Steel: As a result of the Northridge Earthquake, OSHPD issued a post-
bid Policy Intent Notice that would have drastically changed the structural
design of the new building. A less costly design solution was developed by the
structural engineer and approved by OSHPD. OK is presently negotiating the
changes with the contractor.
Outstanding Bid Package 2 claims: Negotiations took place this report period for
all outstanding contractor claims. The claims totaled $203,000, and were
resolved in the amount of $145,000.

9. Met with CGCC representatives Jim Link and LaRhonda Harper, the new
AA/EEO Manager, to review Division E.
10. Attended the first Project Affirmative Action Committee meeting held by
CGCG.
11. Completed verification of MBE and WBE certifications for Alpine
Blueprint, Double D Transportation Co., R&A Supplies, Striping Express,
First Fiber Tech Insulation, Co. and Inland Masonry.
12. Attended first tailgate meeting to discuss sexual harassment and
discrimination.

1. Continued to verify certifications for MBE and WBE firms listed by
CGCC.
2. Attended weekly meetings with the County's AA/CCO Officer.

1. Develop a questionnaire form for site visit verification interviews. Form
will be completed by DSI's interviewer.
2. Conduct weekly and unannounced site visit interviews using the newly-
developed form.
3. Will begin receiving weekly certified payrolls.
4. Provide bi-weekly reports to the County's AA/CCO Officer on findings of
employment compliance (or non-compliance) by comparing 1) DSI site
visit verifications; 2) DSI site visit interviews; 3) CGCC site visit
verifications and 4) certified weekly payroll records.
5. Continue to review certifications for MBE and WBE firms listed by CGCC.
6. Submit written findings of Carone's award of the excavation contract.
7. Meet with CGCC and O'Brien-Kreitzberg and Associates, Inc. to refine
workforce projections using the project's Master Schedule.
8. Determine the date of the upcoming Partnering Workshop and develop a

Rehire and Namecall Procedure
Merrithew Memorial Replacement Hospital Proiect
Per Contra Costa County's Affirmative Action/Equal Employment Opportunity Program
for the Merrithew Memorial Replacement Hospital Project, as stated in Division E,
Section 11-B, the contractor and subcontractors shall notify the union (hiring hall) in
writing if the employment goal of this project is not being met. The contractor will work
with the local union where there is a signatory agreement with the local union and
associated crafts in the following manner:
The contractor shall forward personnel requests to the union and to the County's
Affirmative Action Office (hereinafter referred to as the "dual notification process")
specifying the residency and ethnicity/gender of the personnel requested.
' a. When requesting workers the Individual Employer shall submit fob orders
indicating the number of persons desired, qualifications of each person desired, the
' location of the job, the reporting date and time, and the representative of the
individual employer to be contacted on the job site.
b. The appropriate hiring hall of the Local Union will furnish in accordance with the
request of the individual employer such qualified and competent workers of the
classifications needed from among those entered on said lists to the Individual
Employer by use of a written referral in the following order of preference:
(1) Persons shall be referred in the order in which they are registered if their
registration indicates that they are qualified for and desirous of taking such
referral;
(2) The Individual Employer may request a person by name, out of order, and
such person must be dispatched if such person is registered on the out-of-
work fist and if such person was employed previously by such Individual
Employer or member of a joint venture within three years prior to such
request within the territorial jurisdiction of the appropriate Local Union of
the Union.
(3) In addition, the Individual Employer may request any person registered on
the out-of-work fist out of order for any reasons; provided, however, that
at no time shall any job contain more than 50% of persons requested under
this provision. It will not be a violation for an owner (1 person) to perform

with at least one (1) additional laborer on the job site.
(4) Any Local Union, may at its option, permit a percentage of individual
requests greater than 50% on any job. Such permission shall not be
deemed a violation of the agreement.

placement programs.

unlisted work. They were referred to Centex Golden Construction
Company(CGCC).
4. Developed form for documentation of findings on site visits.
5. Began making weekly and unannounced site visits during the week of July
