RECOMMENDED ACTION: Approve and authorize the Chair, Board of Supervisors, to execute on behalf of the County, Standard Agreement (Amendment) #29-203-59 (State #94-19669-A1) with the State Department of Health Services, effective April 1, 1995, for the Supplemental Food Program for Women, Infants and Children (WIC) . II. FINANCIAL IMPACT: This amendment formally encumbers $65, 163 in State funding (Federal funds) for the WIC Program, for a new total of $1, 337, 198, for the „1994-95 Federal Fiscal Year. No County funds are required. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: The WIC Program is a nutrition education, counseling, and food supplement program for low-income, pregnant, postpartum and breast- feeding women, infants and children at nutritional risk, and is mandated under the Community Health Services Division of the State Department of Health Services. The State has notified the Department of a supplementary award of $65, 163 to support a revised caseload of 13 , 400 (or 700 additional) clients. Standard Agreement (Amendment) #29-203-59 formally encumbers the additional monies and allows minor revisions to line items in the budget. The Board Chair should sign eight copies of the agreement, seven of which should then be returned to the Contracts and Grants Unit. In addition, three certified/sealed copies of the Board Order should be returned to the Contracts and Grants Unit for submission to the State Department of Health Services. In the event of such termination the State may proceed with the work in any manner deemed proper by the state. The cost to the State shall be deducted from any sum due the Contractor under this agreement, and the balance, if any, shall be paid the Contractor upon demand. 4. Without the written consent of the state, this agreement is not assignable by Contractor either in whole or in part. 5. Time is of the essence in this agreement. 6. No alteration or variation of the terms of this contract shall be valid unless made in writing and signed by the parties hereto,and no oral understanding or agreement not incorporated herein,shall,be binding on any of the parties hereto. 7. The consideration to be paid Contractor,as provided,herein,shall be in compensation for all of Contractor's expenses incurred in the performance hereof, including travel and per diem, unless otherwise expressly so provided. w ' Contra Costa County Health Services 94-196613-A1 ` C. Section II, CONTRACTOR'S.ROLE AND RESPONSIBILITIES, Paragraph G, Services to be Provided, Subparagraph 3, Page 9 of 22, is amended to read: "3. Contractor agrees to distribute food vouchers to 13,400 participants monthly. The - State will provide the Contractor with the necessary food vouchers." D. Section ll, CONTRACTOR'S ROLE AND RESPONSIBILITIES, Paragraph K, Americans with Disabilities Act, is added to read: K. Americans with Disabilities Act The Contractor shall comply with all requirements established under the Americans with Disabilities Act, in order to make programs accessible to all participants and to provide equally effective communication. E. Section V, SPECIAL PROVISIONS, Paragraph D, Target Population Proposals, is added to read: D. Target Population Proposals 1. Contractor's written proposal for expanded access to specified target population(s) (i.e., American Indians and/or African Americans) submitted to the State, is not attached hereto, but is incorporated herein and made a part hereof by this reference, as if set forth in full. 2. In recognition of Contractor's need to improve access for eligible American Indians and/or African Americans, as specified in Contractor's written proposal submitted to the State, Contractor may be allocated additional caseload and administrative funds for service to these targeted population(s). If such additional funds have been so allocated, the State will notify the Contractor, in writing, and the funds are to be allocated throughout the Exhibit C1. 3. Contractor agrees to: (a) Establish the foundation necessary to increase access for the target population(s). (b) Submit a written status report by December 15, 1995 to the State. The report must include: (1) A description of the specific activities undertaken towards the establishment of the foundation necessary to increase access for the target,population(s); and (2) The number of participants served in each target population(s) during June 1995. If the status report does not indicate that positive steps have been undertaken to establish the foundation necessary to increase access for the target population(s), the State reserves the right to reduce the Contractor's federal fiscal year 1995-96 caseload allocation and administrative funding for the target population(s). 2. The effective date of this Amendment is April 1, 1995. 3. All other terms and provisions of said Agreement remain in full force and effect.
