SUBJECT: Prohibiting Use of Skateboards, Rollerblades or Toy Vehicles in Signposted
Blackhawk Commercial Areas
SPECIFIC REQUFffrM OR RECOAMMNDATION(S)&BACKGROUND AND JUSTIFICATION
The Blackhawk Commercial Owners Association and Lt. Gary Hall of the Blackhawk Sheriff's substation
have requested,in accordance with Ordinance No.93-54,the prohibition of Skateboards,Rollerblades and
Toy Vehicle Use in Signposted Commercial Areas in Blackhawk Plaza.
RECOMMENDATION:
ADOPT the attached Resolution to prohibit the Use of Skateboards, Rollerblades and Toy Vehicle Use
in Signposted Blackhawk Plaza Commercial Areas.
FISCAL IMPACT:
The cost of acquiring, erecting and maintaining the appropriate signs will be borne by the Blackhawk
Commercial Owners Association. Enforcement of the Resolution's provisions can be accommodated by
current law enforcement levels.
DISCUSSION•
In response to a request by Alamo merchants in 1993, the Board considered the development of an
ordinance for the prohibition of skateboards and toy vehicles. Accordingly,Ordinance 93-54 was adopted
by the Board on August 3, 1993, with the ordinance providing for its future enactment by the Board of
Supervisors' option of an enabling resolution. The resolution must designate the area subject to the
restrictions of Ordinance 93-54 (See Section 46-12.208). The burgeoning use of rollerblades, in addition
to continued popularity of skateboards,has increased the potential for conflict with pedestrians and motor.
vehicles in both parking and pedestrian areas in the Blackhawk Commercial areas. It' is that
circumstance which prompts this request.

Pursuant to Contra Costa County Ordinance Code Chapter 46-12
(Ord. No . 93-54) , use of skateboard, toy vehicle and similar
devices may be prohibited within designated signposted commercial
areas .
In accordance with Section 46-12 .208 of the Ordinance Code
this Board HEREBY DESIGNATES Blackhawk commercial district areas
zoned as P-1, (Planned Unit District) by County Ordinances Nos . 85-
33 and 74-55 and related approved final development plans, as
signposted commercial areas .
Unless and until this resolution is amended or repealed, the
provisions and prohibition of said Chapter 46-12 (Ordinance No 1 .
93-54) shall be applicable to the above-described Blackhawk
signposted commercial areas .
I hereby certify that this is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the date shown.

The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text from
the enacted or amended provisions of the County Ordinance Code) .
SECTION I . Chapter 46-12 is added to the Contra Costa County
Ordinance Code to read:
Chapter 46-12 SKATEBOARD AND TOY VEHICLE RESTRICTIONS
Article 46-12 . 2 Definitions
46-12 . 202 Generally. Unless otherwise specially provided or
required by the context, the following terms have the indicated
meaning in this chapter.
46-12 . 204 Commercial area . "Commercial area,, means any area
contained within districts zoned C-B community business, N-B
neighborhood business (including its planned district) , R-B
retail business, C general commercial, and P-1 planned unit
designated commercial areas .

,., 46-12 . 206 Sheriff . "Sheriff" means the Contra Costa County
Sheriff and includes any duly authorized deputies . The Sheriff
shall be responsible for administration of this chapter.

46-12 . 208 Signposted Commercial Area . "Signposted
commercial area" is any commercial area designated by resolution
of the board of supervisors as an area subject to this chapter' s
restrictions and within which signs are erected and maintained
indicating thereon the prohibited conduct or activity.

Article 46-12 .4 Skateboard and Toy Vehicles
46-12 . 402 Prohibitions . Within any signposted commercial
area, it shall be unlawful for any person upon:
(1 ) A skateboard or riding upon or by means of any coaster,
skateboard, toy vehicle or similar device to go up on any
highway, roadway, or upon any sidewalk or paved surface located
in any such commercial area.

( 2 ) A skateboard, toy vehicle, or similar device to go upon
commercial or public structure or lot located in any such
commercial area which is designed or used to accommodate the
parking of motorized vehicles .

46-12 .404 Posting. Upon the designation of a signposted
commercial area, appropriate signs shall be erected and
maintained in the area.

SECTION II. EFFECTIVE DATE. This ordinance becomes effective
30 days after passage, and within 15 days of passage shall be
published once with the names of the Supervisors voting for and
against it in the CONTRA COSTA TIMES , a newspaper published in
this County.
