SUBJECT: LAW LIBRARY ISSUES
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. ACCEPT this report on the status of discussions between the Law Library Board of
Trustees and County staff on the issues of the Law Library paying for its share of
occupancy costs and the settlement of claims for retroactive payment of interest
earnings.
2. DIRECT County staff to continue to meet with the Law Library Board of Trustees in
an effort to reach a mutually acceptable agreement on these issues and report their
conclusions back to the Internal Operations Committee.
BACKGROUND:
On December 20, 1994, the Board of Supervisors adopted a report from the 1994 Internal
Operations Committee on this subject and referred this matter to our Committee for
continuing oversight.
On August 7, 1995, our Committee met with Trustee David Del Simone, Law Librarian
Jean Steffensen and Capital Facilities Analyst Carol Chan. Ms. Chan reported that the
County presented a written proposal to the Law Library Board of Trustees at their May 25,
1995 meeting to settle the remaining outstanding issues regarding the Law Library
payment for its share of occupancy costs and claims for retroactive payment of interest
earnings on law library funds held by the County Treasurer.

It is proposed that the County would waive its claim to occupancy costs reimbursement
accrued prior to July 1, 1995 and the Law Library would waive its claim to retroactive
interest earnings prior to July 1, 1993. The Auditor-Controller credited interest earnings
to the Law Library Fund effective July 1, 1993.
From July 1, 1995, all interest earnings on the Law Library funds would be credited against
Law Library occupancy costs. Any excess of earnings over the occupancy costs would be
credited to the Law Library Fund. If occupancy costs exceed Law Library interest
earnings, the Board of Trustees would authorize payment from the Law Library Fund for
one half of the difference.
This proposal is still under consideration by the Law Library Board of Trustees. The
County and Law Library Board of Trustees entered into a Tolling Agreement, which tolled
the statute of limitations of the respective claims of each party, effective January 1, 1995
through June 30, 1995. Staff is in the provess of extending this agreement to November
1, 1995.
Staff will report this matter back to the Internal Operations Committee as soon as a
response is received from the Law Library Board of Trustees and we will then report it back
to the Board of Supervisors for whatever action is required.
