C out / SUBJECT: REPORT ON THE DRAFT 1995 CONGESTION MANAGEMENT PROGRAM UPDATE SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Support the changes proposed by the Contra Costa Transportation Authority's Technical Coordinating Committee to the land use evaluation component of the Congestion Management Program so that non-conformance with Measure C-1988 Action Plan process does not constitute non-conformance with the Congestion Management Program. FISCAL IMPACT No fiscal impact to the General Fund. The compliance requirements as defined in the Congestion Managment Program (CMP) could threaten the County's eligibility for Proposition 1 1 1 funds if the County does not comply with Measure C-1988. These funds are used primarily for road safety and maintenance projects. BACKGROUND/REASONS FOR RECOMMENDATIONS The Contra Costa Transportation Authority's (Authority) Technical Coordinating Committee has informed the Regional Committees and local agency staff of their concern about imposing Measure C-1988 requirements as conditions for receiving local allocations of Proposition 111 gas tax revenues, in cases where Measure C-1988 requirements are different than Proposition 111 (see Exhibit A). The 1995 CMP Update does this by imposing the Measure C-1988 action plan process for mitigation regional transportation projects as the condition for meeting the CMP's land use evaluation requirement. The Technical Coordinating Committee's concern arises from the specific test of compliance for the land use evaluation program in Proposition 1 1 1 which is significantly different and less complex than the multi-jurisdictional action plan requirement of Measure C-1988. That JPA states: "It is expressly understood and agreed among the parties hereto that the Congestion Management Program and the Growth Management Programs impose separate requirements upon the localAgencies. Non-conformance with any requirement of one of such programs shall not constitute non-conformance with a requirement of the other program, unless it also constitutes a separate requirement of the other program. " The JPA relates the CMP and Measure C-1988 to promote efficiency in meeting both statutes, but not to link Measure C-1988 compliance with the CMP where they differ. As a result, the Technical Coordinating Committee has prepared changes to the CMP which would provide local jurisdictions with an alternative approach to meet the land use evaluation requirements of the CMP should they choose not to comply with the Measure C-1988 action plan process for mitigating regional traffic impacts. The Transportation Committee believes the concern identified by the Technical Coordinating Committee is valid and the proposed modifications are consistent with the CMP statute and the JPA designating the Authority as the Congestion Management Agency. The Committee urges the Board representatives to the Regional Committees and the Authority to support the CMP changes proposed by the Technical Coordinating Committee. The Authority will consider adoption of the CMP in October.
