SUBJECT: Exchange of Surplus Property
2565 Oak Road
Project No. 0663-4286
Walnut Creek Area
Contra Costa County acquired certain Real Property located at 2565 Oak Road
in Walnut Creek for Road Purposes in 1971 . The southerly 50 feet of said property
is encumbered by an access easement now held by the adjacent property owners, Ralph
Anavy, Mark S. Litwin and Jonathan Quint.
The southerly 25 foot portion of said property, described in Exhibit "A" attached
hereto and made a part hereof is DETERMINED to be surplus and no longer required
for any County or other public purposes and its estimated value does not exceed $10,000.
The Board further DETERMINES the value of the property rights being exchanged to
be equal.
Pursuant to Government Code Section 25526.5 this Board hereby APPROVES and AUTHORIZES
the exchange of County's fee title to the southerly 25 foot portion of said property
for a Quitclaim Deed from said easement holders of all rights on the remaining property.
The Board Chairman is hereby AUTHORIZED to execute a Grant Deed on behalf of
the County conveying said 25 foot portion to said adjacent property owners.
The Real Property Division is DIRECTED to cause said Grant Deed to be placed
in an escrow with Chicago Title Insurance Company with instructions that it be recorded
only after receipt and acceptance by the County of a Quitclaim Deed from said easement
holders, Quitclaiming all their interests in the remaining County owned property.
The project has been determined to be in conformance with the City of Walnut
Creek General Plan.
The Board hereby FINDS that the project will not have a significant effect on
the environment, and DETERMINES that the project is exempt from the requirements
of the California Environmental Quality Act as a Class 5(a) Categorical Exemption
under County Guidelines and Section 15112 of the State CEQA Guidelines, and DIRECTS
the Public Works Director to file a Notice of Exemption with the County Clerk.

Being a portion of the south one half of the parcel of land described as "Parcel
,2" in the deed from Dorothea Rouke and Catherine Rouke to Contra Costa County, recorded
May 13, 1971, in Book 6380 of Official Records, at page 254, records of Contra Costa
County, California; also being a portion of Lot 41 and Lot 42 as designated on the
map entitled "Subdivision No. 1, Larkey Ranch, Walnut Creek, California", filed January 5,
1911, in Book 4 of Maps, at page 79; records of Contra Costa County, California;
more particularly described as follows:
Commencing at a point on the north line of Lot 41 and the west line of the parcel
of land described in the deed from Ottis Chilcott to Contra Costa County; being the
west line of Oak Road recorded September 24, 1941, in Book 622 of Official Records,
at page 194, records of Contra Costa County, California; thence from said point of
commencement south 8o 46' 21" West along the west line of Oak Road (622 O.R. 194)9
142.98 feet to a point on a line parallel with and 25.77 feet southerly measured
at right angle from the north line of said Parcel 2, (6380 O.R. 254), thence North
88o 30' 09" West along said parallel line, 22.18 feet to the True Point of Beginning;
thence continuing from said true point of beginning along said parallel line North
88o 30' 09" West, 94.37 feet to a point on the southerly prolongation of the west
line of the parcel of land described in Parcel 1 in said deed (6380 O.R. 254) ; thence
along said prolongation South to 04' 45" East, 25.80 feet to a point on the south
line of said Parcel 2, (6380 O.R. 254) thence South 88o 30' 09" East along said south
line 89.92 feet to a point on a line parallel with and 22.0 feet westerly measured
at right angle from the said west line of Oak Road, thence North 8o 46' 21" East
along said parallel line 25.98 feet to the True Point of Beginning.
Containing 2375 square feet more or less.
