Request County Counsel to 1) Communicate with Sun Valley Village and SUBJECT: Manufactured Home Communities, Inc. , (Concord Cascade); 2) Seek Editorial Amendment; and 3) Provide Clarification of Certain Terms in the Mobilehome Space Rent Stabilization Ordinance SPECIFIC REOUEST(S)OR RECOMMENDATION(S)6 BACKGROUND AND JUSTIFICATION RECOMMENDATION REQUEST County Counsel to: 1) Communicate with Sun Valley Village and Manufactured Home Communities, Inc. , (Concord Cascade) . 2) Seek editorial amendment to Section 540-2.814(h) . 3) Provide clarification of Section 540-2.1204(4) . 4) Provide clarification of Section 540-2.1210(e), BACKGROUND 1) See attached notices from Sun Valley Village and Manufactured Home Communities, Inc. , (Concord Cascade) to mobilehome residents of spaces covered by the Mobilehome Space Rent Stabilization Ordinance which took effect July 27, 1995. The notices appear to be deficient in meeting the requirements of the county's ordinance, and it is important that County Counsel review the notices and communicate to the management of these parks counsel's opinion as to the possible need for corrective action. 2) Section 540-2.814(h) discusses the option of a hearing officer not rendering and mailing a decision within 20 days of the conclusion of a hearing, so that any decision, whether granting or denying a rental increase, must be mailed to both parties (proponent and opponent) and it must be mailed by certified mail. 3) Section 540-2.1204(4) discusses a park owner's ability to seek a rent increase for capital improvements no later than 24 months after the work has been completed. Article 540-2.04, Standard Annual Rent Increase Please be advised your base..rent will increase 3% of $445.00. The-dollar .amount will be $13.35, which will raise your base rent to $458.35, effective November 1, 1995. This rent increase is consistent with the standard rent increase limitation of Section 540-2.404. It is unclear if some of the items listed are capital improvements or operating expenses; i.e. , lights, painting, roofing, stucco. It would be helpful to have clarification of what is a capital expenditure and what is an operating expense. Also, there appears to be three columns under the "Asset Life in Years" heading.
