SUBJECT: RESOLUTION ACCEPTING A QUITCLAIM DEED FROM HUD FOR CERTAIN PROPERTY
IN NORTH RICHMOND
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
APPROVE Board Resolution No. 3756 ACCEPTING, on behalf of the Housing Authority of the County of
Contra Costa,that certain Quitclaim Deed, dated and delivered July 21, 1995, from the Secretary of the US
Department of Housing and Urban Development(HUD)for certain Housing Authority owned property in North
Richmond, described in Exhibit A, and DIRECT the County Real Property Division to have the Quitclaim Deed
recorded in the Office of the County Recorder.

III. REASONS FOR RECOMMENDATION/BACKGROUND
Pursuant to a Disposition and Development Agreement between the Contra Costa Redevelopment Agency
(Redevelopment Agency)and Community Housing Development Corporation of North Richmond(CHIC), dated
September 13, 1994, the Redevelopment Agency has been working for the last 2 years to acquire all the sites on the
block bounded by Chesley, Third, Grove, and Second in North Richmond for a 52 unit affordable senior housing
complex to be developed by CHDC. The Housing Authority owned one of these sites which has two vacant public
housing units, 212 Grove and 1553 Third. The Redevelopment Agency and the Housing Authority have been going
through the eminent domain process regarding the site and determined the fair market value of the site to be
$72,600. The property has been conveyed to the Redevelopment Agency by stipulated judgment and the$72,600
will be paid to the Housing Authority pursuant to the terms of the judgment.
Because the property was owned by the Housing Authority as a public housing site, it was encumbered by a
Declaration of Trust recorded by HUD which prohibited the Housing Authority from selling the site without HUD
approval. Prior to completing the eminent domain process, it was necessary to solicit HUD's approval. On July 21,
1995,HUD delivered a release of the Declaration of Trust by Quitclaim Deed to the Housing Authority for that
property. The stipulated Judgment transferring title to the Redevelopment Agency and the Final Condemnation
were recorded on July 24, 1995. The purpose of this action is to remove the Declaration of Trust from the record
title to the property.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect to not to accept the Quitclaim Deed and direct that it be recorded,
future development of affordable senior housing at that site in North Richmond might be jeopardized by a cloud on
the title.

ACCEPTING A QUITCLAIM DEED FROM THE U.S.DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT(HUD)RELEASING A DECLARATION OF TRUST ON CERTAIN
PROPERTY IN NORTH RICHMOND
WHEREAS, the Housing Authority of the County of Contra Costa(hereinafter referred to as"Housing Authority")is
a public body,corporate and politic established under the laws of California and empowered to own
property;and
WHEREAS, pursuant to a Disposition and Development Agreement between the Contra Costa Redevelopment
Agency(hereinafter referred to as"Redevelopment Agency")and Community Housing Development
Corporation of North Richmond(hereinafter referred to as"CHDC")dated September 13, 1994,the
Redevelopment Agency has been in the process of acquiring all the sites on the block bounded by
Chesley,Third,Grove,and Second in North Richmond for a 52 unit affordable senior housing complex
to be developed by CHDC;and
WHEREAS, the Housing Authority owned one of these sites which has two vacant public housing units,212 Grove
and 1553 Third;and
WHEREAS, the Redevelopment Agency initiated an eminent domain action on the property and determined the fair
market value of the site to be$72,600 and the Housing Authority agreed to said fair market value;and
WHEREAS, because the property was owned by the Housing Authority as a public housing site,it was encumbered by
a Declaration of Trust recorded by HUD which prohibited the Housing Authority from selling the site
without HUD approval;and
WHEREAS, on July 21, 1995 HUD delivered a Quitclaim Deed,Exhibit A,to the Housing Authority for the property,
releasing HUD's Declaration of Trust;and
WHEREAS, the stipulated Judgment transferring title to the Redevelopment Agency and the Final Condemnation
were recorded on July 24, 1995;and
WHEREAS, the best interests of the Housing Authority and the Redevelopment Agency would be served by
authorizing and directing the Chair of the Board of Commissioners,on behalf of the Housing Authority,
to accept the Quitclaim Deed and to direct that it be recorded in the Office of the County Recorder.
NOW,THEREFORE,BE IT RESOLVED,as follows:
1. That the Board of Commissioners of the Housing Authority of the County of Contra Costa hereby
accepts,on behalf of the Housing Authority,that certain Quitclaim Deed dated July 21, 1995,from HUD regarding the
property and directs the County Real Property Division to have the Quitclaim Deed recorded in the Office of the
County Recorder.
2. That this resolution shall take effect immediately.

The Secretary of the U.S. Department of Housing and Urban
Development, quitclaims to the Housing Authority of the County of Contra
Costa all right, title, and interest in the real property situated in
the County of Contra Costa, State of California, described as follows:
All of Lots 5 and 6 and the South 40 feet (right angle
measurements) of Lots 7 and 8, Block 71, as shown on the Map
of North Richmond Land and Ferry company, Tract No. 2, filed
September 19, 1911, in Book 5 of Maps, Page 124, in the
office of the County Recorder of Contra Costa County.
